  2. Version 2.0, January 2004

  4. TERMS AND CONDITIONS FOR USE, REPRODUCTION, AND DISTRIBUTION
  5. 1. Definitions.
  6. "License" shall mean the terms and conditions for use, reproduction,
  7. and distribution as defined by Sections 1 through 9 of this document.
  8. "Licensor" shall mean the copyright owner or entity authorized by
  9. the copyright owner that is granting the License.
  10. "Legal Entity" shall mean the union of the acting entity and all
  11. other entities that control, are controlled by, or are under common
  12. control with that entity. For the purposes of this definition,
  13. "control" means (i) the power, direct or indirect, to cause the
  14. direction or management of such entity, whether by contract or
  15. otherwise, or (ii) ownership of fifty percent (50%) or more of the
  16. outstanding shares, or (iii) beneficial ownership of such entity.
  17. "You" (or "Your") shall mean an individual or Legal Entity
  18. exercising permissions granted by this License.
  19. "Source" form shall mean the preferred form for making modifications,
  20. including but not limited to software source code, documentation
  21. source, and configuration files.
  22. "Object" form shall mean any form resulting from mechanical
  23. transformation or translation of a Source form, including but
  24. not limited to compiled object code, generated documentation,
  25. and conversions to other media types.
  26. "Work" shall mean the work of authorship, whether in Source or
  27. Object form, made available under the License, as indicated by a
  28. copyright notice that is included in or attached to the work
  29. (an example is provided in the Appendix below).
  30. "Derivative Works" shall mean any work, whether in Source or Object
  31. form, that is based on (or derived from) the Work and for which the
  32. editorial revisions, annotations, elaborations, or other modifications
  33. represent, as a whole, an original work of authorship. For the purposes
  34. of this License, Derivative Works shall not include works that remain
  35. separable from, or merely link (or bind by name) to the interfaces of,
  36. the Work and Derivative Works thereof.
  37. "Contribution" shall mean any work of authorship, including
  38. the original version of the Work and any modifications or additions
  39. to that Work or Derivative Works thereof, that is intentionally
  40. submitted to Licensor for inclusion in the Work by the copyright owner
  41. or by an individual or Legal Entity authorized to submit on behalf of
  42. the copyright owner. For the purposes of this definition, "submitted"
  43. means any form of electronic, verbal, or written communication sent
  44. to the Licensor or its representatives, including but not limited to
  45. communication on electronic mailing lists, source code control systems,
  46. and issue tracking systems that are managed by, or on behalf of, the
  47. Licensor for the purpose of discussing and improving the Work, but
  48. excluding communication that is conspicuously marked or otherwise
  49. designated in writing by the copyright owner as "Not a Contribution."
  50. "Contributor" shall mean Licensor and any individual or Legal Entity
  51. on behalf of whom a Contribution has been received by Licensor and
  52. subsequently incorporated within the Work.
  53. 2. Grant of Copyright License. Subject to the terms and conditions of
  54. this License, each Contributor hereby grants to You a perpetual,
  55. worldwide, non-exclusive, no-charge, royalty-free, irrevocable
  56. copyright license to reproduce, prepare Derivative Works of,
  57. publicly display, publicly perform, sublicense, and distribute the
  58. Work and such Derivative Works in Source or Object form.
  59. 3. Grant of Patent License. Subject to the terms and conditions of
  60. this License, each Contributor hereby grants to You a perpetual,
  61. worldwide, non-exclusive, no-charge, royalty-free, irrevocable
  62. (except as stated in this section) patent license to make, have made,
  63. use, offer to sell, sell, import, and otherwise transfer the Work,
  64. where such license applies only to those patent claims licensable
  65. by such Contributor that are necessarily infringed by their
  66. Contribution(s) alone or by combination of their Contribution(s)
  67. with the Work to which such Contribution(s) was submitted. If You
  68. institute patent litigation against any entity (including a
  69. cross-claim or counterclaim in a lawsuit) alleging that the Work
  70. or a Contribution incorporated within the Work constitutes direct
  71. or contributory patent infringement, then any patent licenses
  72. granted to You under this License for that Work shall terminate
  73. as of the date such litigation is filed.
  74. 4. Redistribution. You may reproduce and distribute copies of the
  75. Work or Derivative Works thereof in any medium, with or without
  76. modifications, and in Source or Object form, provided that You
  77. meet the following conditions:
  78. (a) You must give any other recipients of the Work or
  79. Derivative Works a copy of this License; and
  80. (b) You must cause any modified files to carry prominent notices
  81. stating that You changed the files; and
  82. (c) You must retain, in the Source form of any Derivative Works
  83. that You distribute, all copyright, patent, trademark, and
  84. attribution notices from the Source form of the Work,
  85. excluding those notices that do not pertain to any part of
  86. the Derivative Works; and
  87. (d) If the Work includes a "NOTICE" text file as part of its
  88. distribution, then any Derivative Works that You distribute must
  89. include a readable copy of the attribution notices contained
  90. within such NOTICE file, excluding those notices that do not
  91. pertain to any part of the Derivative Works, in at least one
  92. of the following places: within a NOTICE text file distributed
  93. as part of the Derivative Works; within the Source form or
  94. documentation, if provided along with the Derivative Works; or,
  95. within a display generated by the Derivative Works, if and
  96. wherever such third-party notices normally appear. The contents
  97. of the NOTICE file are for informational purposes only and
  98. do not modify the License. You may add Your own attribution
  99. notices within Derivative Works that You distribute, alongside
  100. or as an addendum to the NOTICE text from the Work, provided
  101. that such additional attribution notices cannot be construed
  102. as modifying the License.
  103. You may add Your own copyright statement to Your modifications and
  104. may provide additional or different license terms and conditions
  105. for use, reproduction, or distribution of Your modifications, or
  106. for any such Derivative Works as a whole, provided Your use,
  107. reproduction, and distribution of the Work otherwise complies with
  108. the conditions stated in this License.
  109. 5. Submission of Contributions. Unless You explicitly state otherwise,
  110. any Contribution intentionally submitted for inclusion in the Work
  111. by You to the Licensor shall be under the terms and conditions of
  112. this License, without any additional terms or conditions.
  113. Notwithstanding the above, nothing herein shall supersede or modify
  114. the terms of any separate license agreement you may have executed
  115. with Licensor regarding such Contributions.
  116. 6. Trademarks. This License does not grant permission to use the trade
  117. names, trademarks, service marks, or product names of the Licensor,
  118. except as required for reasonable and customary use in describing the
  119. origin of the Work and reproducing the content of the NOTICE file.
  120. 7. Disclaimer of Warranty. Unless required by applicable law or
  121. agreed to in writing, Licensor provides the Work (and each
  122. Contributor provides its Contributions) on an "AS IS" BASIS,
  123. WITHOUT WARRANTIES OR CONDITIONS OF ANY KIND, either express or
  124. implied, including, without limitation, any warranties or conditions
  125. of TITLE, NON-INFRINGEMENT, MERCHANTABILITY, or FITNESS FOR A
  126. PARTICULAR PURPOSE. You are solely responsible for determining the
  127. appropriateness of using or redistributing the Work and assume any
  128. risks associated with Your exercise of permissions under this License.
  129. 8. Limitation of Liability. In no event and under no legal theory,
  130. whether in tort (including negligence), contract, or otherwise,
  131. unless required by applicable law (such as deliberate and grossly
  132. negligent acts) or agreed to in writing, shall any Contributor be
  133. liable to You for damages, including any direct, indirect, special,
  134. incidental, or consequential damages of any character arising as a
  135. result of this License or out of the use or inability to use the
  136. Work (including but not limited to damages for loss of goodwill,
  137. work stoppage, computer failure or malfunction, or any and all
  138. other commercial damages or losses), even if such Contributor
  139. has been advised of the possibility of such damages.
  140. 9. Accepting Warranty or Additional Liability. While redistributing
  141. the Work or Derivative Works thereof, You may choose to offer,
  142. and charge a fee for, acceptance of support, warranty, indemnity,
  143. or other liability obligations and/or rights consistent with this
  144. License. However, in accepting such obligations, You may act only
  145. on Your own behalf and on Your sole responsibility, not on behalf
  146. of any other Contributor, and only if You agree to indemnify,
  147. defend, and hold each Contributor harmless for any liability
  148. incurred by, or claims asserted against, such Contributor by reason
  149. of your accepting any such warranty or additional liability.
  150. END OF TERMS AND CONDITIONS

  733. 3.1. Availability of Source
  734. Code. Any Covered Software that You distribute or otherwise make available in
  735. Executable form must also be made available in Source Code form and that Source
  736. Code form must be distributed only under the terms of this License. You must
  737. include a copy of this License with every copy of the Source Code form of the
  738. Covered Software You distribute or otherwise make available. You must inform
  739. recipients of any such Covered Software in Executable form as to how they can
  740. obtain such Covered Software in Source Code form in a reasonable manner on or
  741. through a medium customarily used for software exchange.
  742. 3.2.
  743. Modifications. The Modifications that You create or to which You contribute are
  744. governed by the terms of this License. You represent that You believe Your
  745. Modifications are Your original creation(s) and/or You have sufficient rights to
  746. grant the rights conveyed by this License.
  747. 3.3. Required Notices. You must
  748. include a notice in each of Your Modifications that identifies You as the
  749. Contributor of the Modification. You may not remove or alter any copyright,
  750. patent or trademark notices contained within the Covered Software, or any
  751. notices of licensing or any descriptive text giving attribution to any
  752. Contributor or the Initial Developer.
  753. 3.4. Application of Additional Terms.
  754. You may not offer or impose any terms on any Covered Software in Source Code
  755. form that alters or restricts the applicable version of this License or the
  756. recipients rights hereunder. You may choose to offer, and to charge a fee for,
  757. warranty, support, indemnity or liability obligations to one or more recipients
  758. of Covered Software. However, you may do so only on Your own behalf, and not on
  759. behalf of the Initial Developer or any Contributor. You must make it absolutely
  760. clear that any such warranty, support, indemnity or liability obligation is
  761. offered by You alone, and You hereby agree to indemnify the Initial Developer
  762. and every Contributor for any liability incurred by the Initial Developer or
  763. such Contributor as a result of warranty, support, indemnity or liability terms
  764. You offer.
  765. 3.5. Distribution of Executable Versions. You may distribute the
  766. Executable form of the Covered Software under the terms of this License or under
  767. the terms of a license of Your choice, which may contain terms different from
  768. this License, provided that You are in compliance with the terms of this License
  769. and that the license for the Executable form does not attempt to limit or alter
  770. the recipients rights in the Source Code form from the rights set forth in this
  771. License. If You distribute the Covered Software in Executable form under a
  772. different license, You must make it absolutely clear that any terms which differ
  773. from this License are offered by You alone, not by the Initial Developer or
  774. Contributor. You hereby agree to indemnify the Initial Developer and every
  775. Contributor for any liability incurred by the Initial Developer or such
  776. Contributor as a result of any such terms You offer.
  777. 3.6. Larger Works. You
  778. may create a Larger Work by combining Covered Software with other code not
  779. governed by the terms of this License and distribute the Larger Work as a single
  780. product. In such a case, You must make sure the requirements of this License are
  781. fulfilled for the Covered Software.
  782. 4. Versions of the License.
  783. 4.1.
  784. New Versions. Sun Microsystems, Inc. is the initial license steward and may
  785. publish revised and/or new versions of this License from time to time. Each
  786. version will be given a distinguishing version number. Except as provided in
  787. Section 4.3, no one other than the license steward has the right to modify this
  788. License.
  789. 4.2. Effect of New Versions. You may always continue to use,
  790. distribute or otherwise make the Covered Software available under the terms of
  791. the version of the License under which You originally received the Covered
  792. Software. If the Initial Developer includes a notice in the Original Software
  793. prohibiting it from being distributed or otherwise made available under any
  794. subsequent version of the License, You must distribute and make the Covered
  795. Software available under the terms of the version of the License under which You
  796. originally received the Covered Software. Otherwise, You may also choose to use,
  797. distribute or otherwise make the Covered Software available under the terms of
  798. any subsequent version of the License published by the license
  799. steward.
  800. 4.3. Modified Versions. When You are an Initial Developer and You
  801. want to create a new license for Your Original Software, You may create and use
  802. a modified version of this License if You: (a) rename the license and remove
  803. any references to the name of the license steward (except to note that the
  804. license differs from this License); and (b) otherwise make it clear that the
  805. license contains terms which differ from this License.
  806. 5. DISCLAIMER OF WARRANTY.
  807. COVERED SOFTWARE IS PROVIDED UNDER THIS LICENSE ON AN AS IS BASIS,
  808. WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESSED OR IMPLIED, INCLUDING, WITHOUT
  809. LIMITATION, WARRANTIES THAT THE COVERED SOFTWARE IS FREE OF DEFECTS,
  810. MERCHANTABLE, FIT FOR A PARTICULAR PURPOSE OR NON-INFRINGING. THE ENTIRE RISK AS
  811. TO THE QUALITY AND PERFORMANCE OF THE COVERED SOFTWARE IS WITH YOU. SHOULD ANY
  812. COVERED SOFTWARE PROVE DEFECTIVE IN ANY RESPECT, YOU (NOT THE INITIAL DEVELOPER
  813. OR ANY OTHER CONTRIBUTOR) ASSUME THE COST OF ANY NECESSARY SERVICING, REPAIR OR
  814. CORRECTION. THIS DISCLAIMER OF WARRANTY CONSTITUTES AN ESSENTIAL PART OF THIS
  815. LICENSE. NO USE OF ANY COVERED SOFTWARE IS AUTHORIZED HEREUNDER EXCEPT UNDER
  816. THIS DISCLAIMER.
  817. 6. TERMINATION.
  818. 6.1. This License and the rights
  819. granted hereunder will terminate automatically if You fail to comply with terms
  820. herein and fail to cure such breach within 30 days of becoming aware of the
  821. breach. Provisions which, by their nature, must remain in effect beyond the
  822. termination of this License shall survive.
  823. 6.2. If You assert a patent
  824. infringement claim (excluding declaratory judgment actions) against Initial
  825. Developer or a Contributor (the Initial Developer or Contributor against whom
  826. You assert such claim is referred to as Participant) alleging that the
  827. Participant Software (meaning the Contributor Version where the Participant is a
  828. Contributor or the Original Software where the Participant is the Initial
  829. Developer) directly or indirectly infringes any patent, then any and all rights
  830. granted directly or indirectly to You by such Participant, the Initial Developer
  831. (if the Initial Developer is not the Participant) and all Contributors under
  832. Sections 2.1 and/or 2.2 of this License shall, upon 60 days notice from
  833. Participant terminate prospectively and automatically at the expiration of such
  834. 60 day notice period, unless if within such 60 day period You withdraw Your
  835. claim with respect to the Participant Software against such Participant either
  836. unilaterally or pursuant to a written agreement with Participant.
  837. 6.3. In
  838. the event of termination under Sections 6.1 or 6.2 above, all end user licenses
  839. that have been validly granted by You or any distributor hereunder prior to
  840. termination (excluding licenses granted to You by any distributor) shall survive
  841. termination.
  842. 7. LIMITATION OF LIABILITY.
  843. UNDER NO CIRCUMSTANCES AND UNDER
  844. NO LEGAL THEORY, WHETHER TORT (INCLUDING NEGLIGENCE), CONTRACT, OR OTHERWISE,
  845. SHALL YOU, THE INITIAL DEVELOPER, ANY OTHER CONTRIBUTOR, OR ANY DISTRIBUTOR OF
  846. COVERED SOFTWARE, OR ANY SUPPLIER OF ANY OF SUCH PARTIES, BE LIABLE TO ANY
  847. PERSON FOR ANY INDIRECT, SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGES OF ANY
  848. CHARACTER INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOST PROFITS, LOSS OF
  849. GOODWILL, WORK STOPPAGE, COMPUTER FAILURE OR MALFUNCTION, OR ANY AND ALL OTHER
  850. COMMERCIAL DAMAGES OR LOSSES, EVEN IF SUCH PARTY SHALL HAVE BEEN INFORMED OF THE
  851. POSSIBILITY OF SUCH DAMAGES. THIS LIMITATION OF LIABILITY SHALL NOT APPLY TO
  852. LIABILITY FOR DEATH OR PERSONAL INJURY RESULTING FROM SUCH PARTYS NEGLIGENCE TO
  853. THE EXTENT APPLICABLE LAW PROHIBITS SUCH LIMITATION. SOME JURISDICTIONS DO NOT
  854. ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO
  855. THIS EXCLUSION AND LIMITATION MAY NOT APPLY TO YOU.
  856. 8. U.S. GOVERNMENT END USERS.
  857. The Covered Software is a commercial item, as that term is defined in
  858. 48 C.F.R. 2.101 (Oct. 1995), consisting of commercial computer software (as
  859. that term is defined at 48 C.F.R.  252.227-7014(a)(1)) and commercial computer

  882. apply to this License. You agree that You alone are responsible for compliance
  883. with the United States export administration regulations (and the export control
  884. laws and regulation of any other countries) when You use, distribute or

1020. of Covered Software. However, you may do so only on Your own behalf, and not on
1021. behalf of the Initial Developer or any Contributor. You must make it absolutely
1022. clear that any such warranty, support, indemnity or liability obligation is
1023. offered by You alone, and You hereby agree to indemnify the Initial Developer
1024. and every Contributor for any liability incurred by the Initial Developer or
1025. such Contributor as a result of warranty, support, indemnity or liability terms
  1026. You offer.
1027. 3.5. Distribution of Executable Versions.
  1028. You may distribute the
1029. Executable form of the Covered Software under the terms of this License or under
1030. the terms of a license of Your choice, which may contain terms different from
1031. this License, provided that You are in compliance with the terms of this License
1032. and that the license for the Executable form does not attempt to limit or alter
1033. the recipient's rights in the Source Code form from the rights set forth in
1034. this License. If You distribute the Covered Software in Executable form under a
1035. different license, You must make it absolutely clear that any terms which differ
1036. from this License are offered by You alone, not by the Initial Developer or
1037. Contributor. You hereby agree to indemnify the Initial Developer and every
1038. Contributor for any liability incurred by the Initial Developer or such
1039. Contributor as a result of any such terms You offer.
  1040. 3.6. Larger Works.
  1041. You
1042. may create a Larger Work by combining Covered Software with other code not
1043. governed by the terms of this License and distribute the Larger Work as a single
1044. product. In such a case, You must make sure the requirements of this License are
1045. fulfilled for the Covered Software.
1046. 4. Versions of the License.
  1047. 4.1. New Versions.
1048. Oracle is the initial license steward and may publish revised and/or
1049. new versions of this License from time to time. Each version will be given a
1050. distinguishing version number. Except as provided in Section 4.3, no one other
1051. than the license steward has the right to modify this License.
1052. 4.2. Effect of New Versions.
1053. You may always continue to use, distribute or otherwise make the
1054. Covered Software available under the terms of the version of the License under
1055. which You originally received the Covered Software. If the Initial Developer
1056. includes a notice in the Original Software prohibiting it from being distributed
1057. or otherwise made available under any subsequent version of the License, You
1058. must distribute and make the Covered Software available under the terms of the
1059. version of the License under which You originally received the Covered Software.
1060. Otherwise, You may also choose to use, distribute or otherwise make the Covered
1061. Software available under the terms of any subsequent version of the License
1062. published by the license steward.
  1063. 4.3. Modified Versions.
  1064. When You are an
1065. Initial Developer and You want to create a new license for Your Original
1066. Software, You may create and use a modified version of this License if You: (a)
1067. rename the license and remove any references to the name of the license steward
1068. (except to note that the license differs from this License); and (b) otherwise
1069. make it clear that the license contains terms which differ from this
  1070. License.
  1071. 5. DISCLAIMER OF WARRANTY.
1072. COVERED SOFTWARE IS PROVIDED UNDER THIS
1073. LICENSE ON AN “AS IS” BASIS, WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESSED
1074. OR IMPLIED, INCLUDING, WITHOUT LIMITATION, WARRANTIES THAT THE COVERED SOFTWARE
1075. IS FREE OF DEFECTS, MERCHANTABLE, FIT FOR A PARTICULAR PURPOSE OR
1076. NON-INFRINGING. THE ENTIRE RISK AS TO THE QUALITY AND PERFORMANCE OF THE COVERED
1077. SOFTWARE IS WITH YOU. SHOULD ANY COVERED SOFTWARE PROVE DEFECTIVE IN ANY
1078. RESPECT, YOU (NOT THE INITIAL DEVELOPER OR ANY OTHER CONTRIBUTOR) ASSUME THE
1079. COST OF ANY NECESSARY SERVICING, REPAIR OR CORRECTION. THIS DISCLAIMER OF
1080. WARRANTY CONSTITUTES AN ESSENTIAL PART OF THIS LICENSE. NO USE OF ANY COVERED
1081. SOFTWARE IS AUTHORIZED HEREUNDER EXCEPT UNDER THIS DISCLAIMER.
  1082. 6. TERMINATION.
1083. 6.1. This License and the rights granted hereunder will
1084. terminate automatically if You fail to comply with terms herein and fail to cure
1085. such breach within 30 days of becoming aware of the breach. Provisions which, by
1086. their nature, must remain in effect beyond the termination of this License shall
  1087. survive.
1088. 6.2. If You assert a patent infringement claim (excluding declaratory
1089. judgment actions) against Initial Developer or a Contributor (the Initial
1090. Developer or Contributor against whom You assert such claim is referred to as
1091. “Participant”) alleging that the Participant Software (meaning the
1092. Contributor Version where the Participant is a Contributor or the Original
1093. Software where the Participant is the Initial Developer) directly or indirectly
1094. infringes any patent, then any and all rights granted directly or indirectly to
1095. You by such Participant, the Initial Developer (if the Initial Developer is not
1096. the Participant) and all Contributors under Sections 2.1 and/or 2.2 of this
1097. License shall, upon 60 days notice from Participant terminate prospectively and
1098. automatically at the expiration of such 60 day notice period, unless if within
1099. such 60 day period You withdraw Your claim with respect to the Participant
1100. Software against such Participant either unilaterally or pursuant to a written
  1101. agreement with Participant.
1102. 6.3. If You assert a patent infringement claim
1103. against Participant alleging that the Participant Software directly or
1104. indirectly infringes any patent where such claim is resolved (such as by license
1105. or settlement) prior to the initiation of patent infringement litigation, then
1106. the reasonable value of the licenses granted by such Participant under Sections
1107. 2.1 or 2.2 shall be taken into account in determining the amount or value of any
  1108. payment or license.
1109. 6.4. In the event of termination under Sections 6.1 or 6.2
1110. above, all end user licenses that have been validly granted by You or any
1111. distributor hereunder prior to termination (excluding licenses granted to You by
1112. any distributor) shall survive termination.
  1113. 7. LIMITATION OF LIABILITY.
1114. UNDER NO CIRCUMSTANCES AND UNDER NO LEGAL THEORY, WHETHER TORT
1115. (INCLUDING NEGLIGENCE), CONTRACT, OR OTHERWISE, SHALL YOU, THE INITIAL
1116. DEVELOPER, ANY OTHER CONTRIBUTOR, OR ANY DISTRIBUTOR OF COVERED SOFTWARE, OR ANY
1117. SUPPLIER OF ANY OF SUCH PARTIES, BE LIABLE TO ANY PERSON FOR ANY INDIRECT,
1118. SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGES OF ANY CHARACTER INCLUDING,
1119. WITHOUT LIMITATION, DAMAGES FOR LOSS OF GOODWILL, WORK STOPPAGE, COMPUTER
1120. FAILURE OR MALFUNCTION, OR ANY AND ALL OTHER COMMERCIAL DAMAGES OR LOSSES, EVEN
1121. IF SUCH PARTY SHALL HAVE BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGES. THIS
1122. LIMITATION OF LIABILITY SHALL NOT APPLY TO LIABILITY FOR DEATH OR PERSONAL
1123. INJURY RESULTING FROM SUCH PARTY'S NEGLIGENCE TO THE EXTENT APPLICABLE LAW
1124. PROHIBITS SUCH LIMITATION. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR
1125. LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THIS EXCLUSION AND
1126. LIMITATION MAY NOT APPLY TO YOU.
  1127. 8. U.S. GOVERNMENT END USERS.
  1128. The Covered
1129. Software is a “commercial item,” as that term is defined in 48 C.F.R. 2.101
1130. (Oct. 1995), consisting of “commercial computer software” (as that term is
  1131. defined at 48 C.F.R. § 252.227-7014(a)(1)) and “commercial computer software
1132. documentation” as such terms are used in 48 C.F.R. 12.212 (Sept. 1995).
  1133. Consistent with 48 C.F.R. 12.212 and 48 C.F.R. 227.7202-1 through 227.7202-4
1134. (June 1995), all U.S. Government End Users acquire Covered Software with only
1135. those rights set forth herein. This U.S. Government Rights clause is in lieu of,
1136. and supersedes, any other FAR, DFAR, or other clause or provision that addresses
1137. Government rights in computer software under this License.
  1138. 9. MISCELLANEOUS.
1139. This License represents the complete agreement concerning
1140. subject matter hereof. If any provision of this License is held to be
1141. unenforceable, such provision shall be reformed only to the extent necessary to
1142. make it enforceable. This License shall be governed by the law of the
1143. jurisdiction specified in a notice contained within the Original Software
1144. (except to the extent applicable law, if any, provides otherwise), excluding
1145. such jurisdiction's conflict-of-law provisions. Any litigation relating to this
1146. License shall be subject to the jurisdiction of the courts located in the
1147. jurisdiction and venue specified in a notice contained within the Original
1148. Software, with the losing party responsible for costs, including, without
1149. limitation, court costs and reasonable attorneys' fees and expenses. The
1150. application of the United Nations Convention on Contracts for the International
1151. Sale of Goods is expressly excluded. Any law or regulation which provides that
1152. the language of a contract shall be construed against the drafter shall not
1153. apply to this License. You agree that You alone are responsible for compliance
1154. with the United States export administration regulations (and the export control
1155. laws and regulation of any other countries) when You use, distribute or
1156. otherwise make available any Covered Software.
  1157. 10. RESPONSIBILITY FOR CLAIMS.
1158. As between Initial Developer and the Contributors, each party is
1159. responsible for claims and damages arising, directly or indirectly, out of its
1160. utilization of rights under this License and You agree to work with Initial
1161. Developer and Contributors to distribute such responsibility on an equitable
1162. basis. Nothing herein is intended or shall be deemed to constitute any admission
  1163. of liability.

  1226. Eclipse Public License - v 1.0
1227. THE ACCOMPANYING PROGRAM IS PROVIDED UNDER THE TERMS OF THIS ECLIPSE PUBLIC
1228. LICENSE ("AGREEMENT"). ANY USE, REPRODUCTION OR DISTRIBUTION OF THE PROGRAM
1229. CONSTITUTES RECIPIENT'S ACCEPTANCE OF THIS AGREEMENT.
  1230. 1. DEFINITIONS
  1231. "Contribution" means:
1232. a) in the case of the initial Contributor, the initial code and documentation
1233. distributed under this Agreement, and
1234. b) in the case of each subsequent Contributor:
1235. i) changes to the Program, and
  1236. ii) additions to the Program;
1237. where such changes and/or additions to the Program originate from and are
1238. distributed by that particular Contributor. A Contribution 'originates' from a
1239. Contributor if it was added to the Program by such Contributor itself or anyone
1240. acting on such Contributor's behalf. Contributions do not include additions to
1241. the Program which: (i) are separate modules of software distributed in
1242. conjunction with the Program under their own license agreement, and (ii) are not
1243. derivative works of the Program.
1244. "Contributor" means any person or entity that distributes the Program.
1245. "Licensed Patents" mean patent claims licensable by a Contributor which are
1246. necessarily infringed by the use or sale of its Contribution alone or when
  1247. combined with the Program.
1248. "Program" means the Contributions distributed in accordance with this Agreement.
1249. "Recipient" means anyone who receives the Program under this Agreement,
  1250. including all Contributors.
  1251. 2. GRANT OF RIGHTS
1252. a) Subject to the terms of this Agreement, each Contributor hereby grants
  1253. Recipient a non-exclusive, worldwide, royalty-free copyright license to
1254. reproduce, prepare derivative works of, publicly display, publicly perform,
1255. distribute and sublicense the Contribution of such Contributor, if any, and such
1256. derivative works, in source code and object code form.
1257. b) Subject to the terms of this Agreement, each Contributor hereby grants
1258. Recipient a non-exclusive, worldwide, royalty-free patent license under Licensed
1259. Patents to make, use, sell, offer to sell, import and otherwise transfer the
1260. Contribution of such Contributor, if any, in source code and object code form.
1261. This patent license shall apply to the combination of the Contribution and the
1262. Program if, at the time the Contribution is added by the Contributor, such
1263. addition of the Contribution causes such combination to be covered by the
1264. Licensed Patents. The patent license shall not apply to any other combinations
1265. which include the Contribution. No hardware per se is licensed hereunder.
1266. c) Recipient understands that although each Contributor grants the licenses to
1267. its Contributions set forth herein, no assurances are provided by any
1268. Contributor that the Program does not infringe the patent or other intellectual
1269. property rights of any other entity. Each Contributor disclaims any liability to
1270. Recipient for claims brought by any other entity based on infringement of
1271. intellectual property rights or otherwise. As a condition to exercising the
1272. rights and licenses granted hereunder, each Recipient hereby assumes sole
1273. responsibility to secure any other intellectual property rights needed, if any.
1274. For example, if a third party patent license is required to allow Recipient to
1275. distribute the Program, it is Recipient's responsibility to acquire that license
  1276. before distributing the Program.
1277. d) Each Contributor represents that to its knowledge it has sufficient copyright
1278. rights in its Contribution, if any, to grant the copyright license set forth in
  1279. this Agreement.
  1280. 3. REQUIREMENTS
1281. A Contributor may choose to distribute the Program in object code form under its
1282. own license agreement, provided that:
1283. a) it complies with the terms and conditions of this Agreement; and
  1284. b) its license agreement:
1285. i) effectively disclaims on behalf of all Contributors all warranties and
1286. conditions, express and implied, including warranties or conditions of title and
1287. non-infringement, and implied warranties or conditions of merchantability and
  1288. fitness for a particular purpose;
1289. ii) effectively excludes on behalf of all Contributors all liability for
1290. damages, including direct, indirect, special, incidental and consequential
  1291. damages, such as lost profits;
1292. iii) states that any provisions which differ from this Agreement are offered by
1293. that Contributor alone and not by any other party; and
1294. iv) states that source code for the Program is available from such Contributor,
1295. and informs licensees how to obtain it in a reasonable manner on or through a
1296. medium customarily used for software exchange.
1297. When the Program is made available in source code form:
1298. a) it must be made available under this Agreement; and
1299. b) a copy of this Agreement must be included with each copy of the Program.
1300. Contributors may not remove or alter any copyright notices contained within the
  1301. Program.
1302. Each Contributor must identify itself as the originator of its Contribution, if
1303. any, in a manner that reasonably allows subsequent Recipients to identify the
  1304. originator of the Contribution.
  1305. 4. COMMERCIAL DISTRIBUTION
1306. Commercial distributors of software may accept certain responsibilities with
1307. respect to end users, business partners and the like. While this license is
1308. intended to facilitate the commercial use of the Program, the Contributor who
1309. includes the Program in a commercial product offering should do so in a manner
1310. which does not create potential liability for other Contributors. Therefore, if
1311. a Contributor includes the Program in a commercial product offering, such
1312. Contributor ("Commercial Contributor") hereby agrees to defend and indemnify
1313. every other Contributor ("Indemnified Contributor") against any losses, damages
1314. and costs (collectively "Losses") arising from claims, lawsuits and other legal
1315. actions brought by a third party against the Indemnified Contributor to the
1316. extent caused by the acts or omissions of such Commercial Contributor in
1317. connection with its distribution of the Program in a commercial product
1318. offering. The obligations in this section do not apply to any claims or Losses
1319. relating to any actual or alleged intellectual property infringement. In order
1320. to qualify, an Indemnified Contributor must: a) promptly notify the Commercial
1321. Contributor in writing of such claim, and b) allow the Commercial Contributor to
1322. control, and cooperate with the Commercial Contributor in, the defense and any
1323. related settlement negotiations. The Indemnified Contributor may participate in
1324. any such claim at its own expense.
1325. For example, a Contributor might include the Program in a commercial product
1326. offering, Product X. That Contributor is then a Commercial Contributor. If that
1327. Commercial Contributor then makes performance claims, or offers warranties
1328. related to Product X, those performance claims and warranties are such
1329. Commercial Contributor's responsibility alone. Under this section, the
1330. Commercial Contributor would have to defend claims against the other
1331. Contributors related to those performance claims and warranties, and if a court
1332. requires any other Contributor to pay any damages as a result, the Commercial
1333. Contributor must pay those damages.
  1334. 5. NO WARRANTY
1335. EXCEPT AS EXPRESSLY SET FORTH IN THIS AGREEMENT, THE PROGRAM IS PROVIDED ON AN
1336. "AS IS" BASIS, WITHOUT WARRANTIES OR CONDITIONS OF ANY KIND, EITHER EXPRESS OR
1337. IMPLIED INCLUDING, WITHOUT LIMITATION, ANY WARRANTIES OR CONDITIONS OF TITLE,
1338. NON-INFRINGEMENT, MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. Each
1339. Recipient is solely responsible for determining the appropriateness of using and
1340. distributing the Program and assumes all risks associated with its exercise of
1341. rights under this Agreement , including but not limited to the risks and costs
1342. of program errors, compliance with applicable laws, damage to or loss of data,
1343. programs or equipment, and unavailability or interruption of operations.
  1344. 6. DISCLAIMER OF LIABILITY
1345. EXCEPT AS EXPRESSLY SET FORTH IN THIS AGREEMENT, NEITHER RECIPIENT NOR ANY
1346. CONTRIBUTORS SHALL HAVE ANY LIABILITY FOR ANY DIRECT, INDIRECT, INCIDENTAL,
1347. SPECIAL, EXEMPLARY, OR CONSEQUENTIAL DAMAGES (INCLUDING WITHOUT LIMITATION LOST
1348. PROFITS), HOWEVER CAUSED AND ON ANY THEORY OF LIABILITY, WHETHER IN CONTRACT,
1349. STRICT LIABILITY, OR TORT (INCLUDING NEGLIGENCE OR OTHERWISE) ARISING IN ANY WAY
1350. OUT OF THE USE OR DISTRIBUTION OF THE PROGRAM OR THE EXERCISE OF ANY RIGHTS
1351. GRANTED HEREUNDER, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
  1352. 7. GENERAL
1353. If any provision of this Agreement is invalid or unenforceable under applicable
1354. law, it shall not affect the validity or enforceability of the remainder of the
1355. terms of this Agreement, and without further action by the parties hereto, such
1356. provision shall be reformed to the minimum extent necessary to make such
  1357. provision valid and enforceable.
1358. If Recipient institutes patent litigation against any entity (including a
1359. cross-claim or counterclaim in a lawsuit) alleging that the Program itself
1360. (excluding combinations of the Program with other software or hardware)
1361. infringes such Recipient's patent(s), then such Recipient's rights granted under
1362. Section 2(b) shall terminate as of the date such litigation is filed.
1363. All Recipient's rights under this Agreement shall terminate if it fails to
1364. comply with any of the material terms or conditions of this Agreement and does
1365. not cure such failure in a reasonable period of time after becoming aware of
1366. such noncompliance. If all Recipient's rights under this Agreement terminate,
1367. Recipient agrees to cease use and distribution of the Program as soon as
1368. reasonably practicable. However, Recipient's obligations under this Agreement
1369. and any licenses granted by Recipient relating to the Program shall continue and
  1370. survive.
1371. Everyone is permitted to copy and distribute copies of this Agreement, but in
1372. order to avoid inconsistency the Agreement is copyrighted and may only be
1373. modified in the following manner. The Agreement Steward reserves the right to
1374. publish new versions (including revisions) of this Agreement from time to time.
1375. No one other than the Agreement Steward has the right to modify this Agreement.
1376. The Eclipse Foundation is the initial Agreement Steward. The Eclipse Foundation
1377. may assign the responsibility to serve as the Agreement Steward to a suitable
1378. separate entity. Each new version of the Agreement will be given a
1379. distinguishing version number. The Program (including Contributions) may always
1380. be distributed subject to the version of the Agreement under which it was
1381. received. In addition, after a new version of the Agreement is published,
1382. Contributor may elect to distribute the Program (including its Contributions)
1383. under the new version. Except as expressly stated in Sections 2(a) and 2(b)
1384. above, Recipient receives no rights or licenses to the intellectual property of
1385. any Contributor under this Agreement, whether expressly, by implication,
1386. estoppel or otherwise. All rights in the Program not expressly granted under
  1387. this Agreement are reserved.
1388. This Agreement is governed by the laws of the State of New York and the
1389. intellectual property laws of the United States of America. No party to this
1390. Agreement will bring a legal action under this Agreement more than one year
1391. after the cause of action arose. Each party waives its rights to a jury trial in
  1392. any resulting litigation.

1454. LICENSE OR COPYRIGHT LAW IS PROHIBITED.
1455. BY EXERCISING ANY RIGHTS TO THE WORK PROVIDED HERE, YOU ACCEPT AND AGREE TO BE
1456. BOUND BY THE TERMS OF THIS LICENSE. THE LICENSOR GRANTS YOU THE RIGHTS CONTAINED
1457. HERE IN CONSIDERATION OF YOUR ACCEPTANCE OF SUCH TERMS AND CONDITIONS.
  1458. 1. Definitions
1459. "Collective Work" means a work, such as a periodical issue, anthology or
1460. encyclopedia, in which the Work in its entirety in unmodified form, along with a
1461. number of other contributions, constituting separate and independent works in
1462. themselves, are assembled into a collective whole. A work that constitutes a
1463. Collective Work will not be considered a Derivative Work (as defined below) for
1464. the purposes of this License.
1465. "Derivative Work" means a work based upon the Work or upon the Work and other
1466. pre-existing works, such as a translation, musical arrangement, dramatization,
1467. fictionalization, motion picture version, sound recording, art reproduction,
1468. abridgment, condensation, or any other form in which the Work may be recast,
1469. transformed, or adapted, except that a work that constitutes a Collective Work
1470. will not be considered a Derivative Work for the purpose of this License. For
1471. the avoidance of doubt, where the Work is a musical composition or sound
1472. recording, the synchronization of the Work in timed-relation with a moving image
1473. ("synching") will be considered a Derivative Work for the purpose of this
  1474. License.
1475. "Licensor" means the individual or entity that offers the Work under the terms
  1476. of this License.
1477. "Original Author" means the individual or entity who created the Work.
1478. "Work" means the copyrightable work of authorship offered under the terms of
  1479. this License.
1480. "You" means an individual or entity exercising rights under this License who has
1481. not previously violated the terms of this License with respect to the Work, or
1482. who has received express permission from the Licensor to exercise rights under
1483. this License despite a previous violation.
1484. 2. Fair Use Rights. Nothing in this license is intended to reduce, limit, or
1485. restrict any rights arising from fair use, first sale or other limitations on
1486. the exclusive rights of the copyright owner under copyright law or other
  1487. applicable laws.
1488. 3. License Grant. Subject to the terms and conditions of this License, Licensor
1489. hereby grants You a worldwide, royalty-free, non-exclusive, perpetual (for the
1490. duration of the applicable copyright) license to exercise the rights in the Work
  1491. as stated below:
1492. to reproduce the Work, to incorporate the Work into one or more Collective
  1493. Works, and to reproduce the Work as incorporated in the Collective Works;
  1494. to create and reproduce Derivative Works;
1495. to distribute copies or phonorecords of, display publicly, perform publicly, and
1496. perform publicly by means of a digital audio transmission the Work including as
  1497. incorporated in Collective Works;
1498. to distribute copies or phonorecords of, display publicly, perform publicly, and
1499. perform publicly by means of a digital audio transmission Derivative Works.
1500. For the avoidance of doubt, where the work is a musical composition:
1501. Performance Royalties Under Blanket Licenses. Licensor waives the exclusive
1502. right to collect, whether individually or via a performance rights society (e.g.
1503. ASCAP, BMI, SESAC), royalties for the public performance or public digital
1504. performance (e.g. webcast) of the Work.
1505. Mechanical Rights and Statutory Royalties. Licensor waives the exclusive right
1506. to collect, whether individually or via a music rights agency or designated
1507. agent (e.g. Harry Fox Agency), royalties for any phonorecord You create from the
1508. Work ("cover version") and distribute, subject to the compulsory license created
1509. by 17 USC Section 115 of the US Copyright Act (or the equivalent in other
  1510. jurisdictions).
1511. Webcasting Rights and Statutory Royalties. For the avoidance of doubt, where the
1512. Work is a sound recording, Licensor waives the exclusive right to collect,
1513. whether individually or via a performance-rights society (e.g. SoundExchange),
1514. royalties for the public digital performance (e.g. webcast) of the Work, subject
1515. to the compulsory license created by 17 USC Section 114 of the US Copyright Act
1516. (or the equivalent in other jurisdictions).
1517. The above rights may be exercised in all media and formats whether now known or
1518. hereafter devised. The above rights include the right to make such modifications
1519. as are technically necessary to exercise the rights in other media and formats.
1520. All rights not expressly granted by Licensor are hereby reserved.
1521. 4. Restrictions. The license granted in Section 3 above is expressly made subject
1522. to and limited by the following restrictions:
1523. You may distribute, publicly display, publicly perform, or publicly digitally
1524. perform the Work only under the terms of this License, and You must include a
1525. copy of, or the Uniform Resource Identifier for, this License with every copy or
1526. phonorecord of the Work You distribute, publicly display, publicly perform, or
1527. publicly digitally perform. You may not offer or impose any terms on the Work
1528. that alter or restrict the terms of this License or the recipients' exercise of
1529. the rights granted hereunder. You may not sublicense the Work. You must keep
1530. intact all notices that refer to this License and to the disclaimer of
1531. warranties. You may not distribute, publicly display, publicly perform, or
1532. publicly digitally perform the Work with any technological measures that control
1533. access or use of the Work in a manner inconsistent with the terms of this
1534. License Agreement. The above applies to the Work as incorporated in a Collective
1535. Work, but this does not require the Collective Work apart from the Work itself
1536. to be made subject to the terms of this License. If You create a Collective
1537. Work, upon notice from any Licensor You must, to the extent practicable, remove
1538. from the Collective Work any credit as required by clause 4(b), as requested. If
1539. You create a Derivative Work, upon notice from any Licensor You must, to the
1540. extent practicable, remove from the Derivative Work any credit as required by
  1541. clause 4(b), as requested.
1542. If you distribute, publicly display, publicly perform, or publicly digitally
1543. perform the Work or any Derivative Works or Collective Works, You must keep
1544. intact all copyright notices for the Work and provide, reasonable to the medium
1545. or means You are utilizing: (i) the name of the Original Author (or pseudonym,
1546. if applicable) if supplied, and/or (ii) if the Original Author and/or Licensor
1547. designate another party or parties (e.g. a sponsor institute, publishing entity,
1548. journal) for attribution in Licensor's copyright notice, terms of service or by
1549. other reasonable means, the name of such party or parties; the title of the Work
1550. if supplied; to the extent reasonably practicable, the Uniform Resource
1551. Identifier, if any, that Licensor specifies to be associated with the Work,
1552. unless such URI does not refer to the copyright notice or licensing information
1553. for the Work; and in the case of a Derivative Work, a credit identifying the use
1554. of the Work in the Derivative Work (e.g., "French translation of the Work by
1555. Original Author," or "Screenplay based on original Work by Original Author").
1556. Such credit may be implemented in any reasonable manner; provided, however, that
1557. in the case of a Derivative Work or Collective Work, at a minimum such credit
1558. will appear where any other comparable authorship credit appears and in a manner
1559. at least as prominent as such other comparable authorship credit.
1560. 5. Representations, Warranties and Disclaimer
1561. UNLESS OTHERWISE MUTUALLY AGREED TO BY THE PARTIES IN WRITING, LICENSOR OFFERS
1562. THE WORK AS-IS AND MAKES NO REPRESENTATIONS OR WARRANTIES OF ANY KIND CONCERNING
1563. THE WORK, EXPRESS, IMPLIED, STATUTORY OR OTHERWISE, INCLUDING, WITHOUT
1564. LIMITATION, WARRANTIES OF TITLE, MERCHANTIBILITY, FITNESS FOR A PARTICULAR
1565. PURPOSE, NONINFRINGEMENT, OR THE ABSENCE OF LATENT OR OTHER DEFECTS, ACCURACY,
1566. OR THE PRESENCE OF ABSENCE OF ERRORS, WHETHER OR NOT DISCOVERABLE. SOME
1567. JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES, SO SUCH
1568. EXCLUSION MAY NOT APPLY TO YOU.
1569. 6. Limitation on Liability. EXCEPT TO THE EXTENT REQUIRED BY APPLICABLE LAW, IN
1570. NO EVENT WILL LICENSOR BE LIABLE TO YOU ON ANY LEGAL THEORY FOR ANY SPECIAL,
1571. INCIDENTAL, CONSEQUENTIAL, PUNITIVE OR EXEMPLARY DAMAGES ARISING OUT OF THIS
1572. LICENSE OR THE USE OF THE WORK, EVEN IF LICENSOR HAS BEEN ADVISED OF THE
  1573. POSSIBILITY OF SUCH DAMAGES.
  1574. 7. Termination
1575. This License and the rights granted hereunder will terminate automatically upon
1576. any breach by You of the terms of this License. Individuals or entities who have
1577. received Derivative Works or Collective Works from You under this License,
1578. however, will not have their licenses terminated provided such individuals or
1579. entities remain in full compliance with those licenses. Sections 1, 2, 5, 6, 7,
1580. and 8 will survive any termination of this License.
1581. Subject to the above terms and conditions, the license granted here is perpetual
1582. (for the duration of the applicable copyright in the Work). Notwithstanding the
1583. above, Licensor reserves the right to release the Work under different license
1584. terms or to stop distributing the Work at any time; provided, however that any
1585. such election will not serve to withdraw this License (or any other license that
1586. has been, or is required to be, granted under the terms of this License), and
1587. this License will continue in full force and effect unless terminated as stated
  1588. above.
  1589. 8. Miscellaneous
1590. Each time You distribute or publicly digitally perform the Work or a Collective
1591. Work, the Licensor offers to the recipient a license to the Work on the same
1592. terms and conditions as the license granted to You under this License.
1593. Each time You distribute or publicly digitally perform a Derivative Work,
1594. Licensor offers to the recipient a license to the original Work on the same
1595. terms and conditions as the license granted to You under this License.
1596. If any provision of this License is invalid or unenforceable under applicable
1597. law, it shall not affect the validity or enforceability of the remainder of the
1598. terms of this License, and without further action by the parties to this
1599. agreement, such provision shall be reformed to the minimum extent necessary to
1600. make such provision valid and enforceable.
1601. No term or provision of this License shall be deemed waived and no breach
1602. consented to unless such waiver or consent shall be in writing and signed by the
1603. party to be charged with such waiver or consent.
1604. This License constitutes the entire agreement between the parties with respect
1605. to the Work licensed here. There are no understandings, agreements or
1606. representations with respect to the Work not specified here. Licensor shall not
1607. be bound by any additional provisions that may appear in any communication from
1608. You. This License may not be modified without the mutual written agreement of
  1609. the Licensor and You.

1735. distribute. You may not offer or impose any terms on any Source Code

1737. License or the recipients' rights hereunder. However, You may include
1738. an additional document offering the additional rights described in
  1739. Section 3.5.
1740. 3.2. Availability of Source Code.
1741. Any Modification which You create or to which You contribute must be
1742. made available in Source Code form under the terms of this License

1766. Contributor must include a text file with the Source Code
1767. distribution titled "LEGAL" which describes the claim and the

1771. Contributor shall promptly modify the LEGAL file in all copies
1772. Contributor makes available thereafter and shall take other steps
1773. (such as notifying appropriate mailing lists or newsgroups)
1774. reasonably calculated to inform those who received the Covered
1775. Code that new knowledge has been obtained.
  1776. (b) Contributor APIs.
1777. If Contributor's Modifications include an application programming
1778. interface and Contributor has knowledge of patent licenses which
1779. are reasonably necessary to implement that API, Contributor must
1780. also include this information in the LEGAL file.
  1781. (c) Representations.
1782. Contributor represents that, except as disclosed pursuant to
1783. Section 3.4(a) above, Contributor believes that Contributor's
  1784. Modifications are Contributor's original creation(s) and/or
1785. Contributor has sufficient rights to grant the rights conveyed by
  1786. this License.
  1787. 3.5. Required Notices.
1788. You must duplicate the notice in Exhibit A in each file of the Source
1789. Code. If it is not possible to put such notice in a particular Source
1790. Code file due to its structure, then You must include such notice in a
1791. location (such as a relevant directory) where a user would be likely
1792. to look for such a notice. If You created one or more Modification(s)
1793. You may add your name as a Contributor to the notice described in
1794. Exhibit A. You must also duplicate this License in any documentation
1795. for the Source Code where You describe recipients' rights or ownership
1796. rights relating to Covered Code. You may choose to offer, and to
1797. charge a fee for, warranty, support, indemnity or liability
1798. obligations to one or more recipients of Covered Code. However, You
1799. may do so only on Your own behalf, and not on behalf of the Initial
1800. Developer or any Contributor. You must make it absolutely clear than
1801. any such warranty, support, indemnity or liability obligation is
1802. offered by You alone, and You hereby agree to indemnify the Initial
1803. Developer and every Contributor for any liability incurred by the
1804. Initial Developer or such Contributor as a result of warranty,
1805. support, indemnity or liability terms You offer.
1806. 3.6. Distribution of Executable Versions.
1807. You may distribute Covered Code in Executable form only if the
1808. requirements of Section 3.1-3.5 have been met for that Covered Code,
1809. and if You include a notice stating that the Source Code version of
1810. the Covered Code is available under the terms of this License,
1811. including a description of how and where You have fulfilled the
1812. obligations of Section 3.2. The notice must be conspicuously included
1813. in any notice in an Executable version, related documentation or
1814. collateral in which You describe recipients' rights relating to the
1815. Covered Code. You may distribute the Executable version of Covered
1816. Code or ownership rights under a license of Your choice, which may
1817. contain terms different from this License, provided that You are in
1818. compliance with the terms of this License and that the license for the
1819. Executable version does not attempt to limit or alter the recipient's
1820. rights in the Source Code version from the rights set forth in this
1821. License. If You distribute the Executable version under a different
1822. license You must make it absolutely clear that any terms which differ
1823. from this License are offered by You alone, not by the Initial
1824. Developer or any Contributor. You hereby agree to indemnify the
1825. Initial Developer and every Contributor for any liability incurred by
1826. the Initial Developer or such Contributor as a result of any such
  1827. terms You offer.
  1828. 3.7. Larger Works.
1829. You may create a Larger Work by combining Covered Code with other code
1830. not governed by the terms of this License and distribute the Larger
1831. Work as a single product. In such a case, You must make sure the
1832. requirements of this License are fulfilled for the Covered Code.
1833. 4. Inability to Comply Due to Statute or Regulation.
1834. If it is impossible for You to comply with any of the terms of this
1835. License with respect to some or all of the Covered Code due to
1836. statute, judicial order, or regulation then You must: (a) comply with
1837. the terms of this License to the maximum extent possible; and (b)
1838. describe the limitations and the code they affect. Such description
1839. must be included in the LEGAL file described in Section 3.4 and must
1840. be included with all distributions of the Source Code. Except to the
1841. extent prohibited by statute or regulation, such description must be
1842. sufficiently detailed for a recipient of ordinary skill to be able to
  1843. understand it.
1844. 5. Application of this License.
1845. This License applies to code to which the Initial Developer has
1846. attached the notice in Exhibit A and to related Covered Code.
1847. 6. Versions of the License.
  1848. 6.1. New Versions.
1849. Netscape Communications Corporation ("Netscape") may publish revised
1850. and/or new versions of the License from time to time. Each version
1851. will be given a distinguishing version number.
1852. 6.2. Effect of New Versions.
1853. Once Covered Code has been published under a particular version of the
1854. License, You may always continue to use it under the terms of that
1855. version. You may also choose to use such Covered Code under the terms
1856. of any subsequent version of the License published by Netscape. No one
1857. other than Netscape has the right to modify the terms applicable to
1858. Covered Code created under this License.
  1859. 6.3. Derivative Works.
1860. If You create or use a modified version of this License (which you may
1861. only do in order to apply it to code which is not already Covered Code
1862. governed by this License), You must (a) rename Your license so that
1863. the phrases "Mozilla", "MOZILLAPL", "MOZPL", "Netscape",
1864. "MPL", "NPL" or any confusingly similar phrase do not appear in your
1865. license (except to note that your license differs from this License)
1866. and (b) otherwise make it clear that Your version of the license
1867. contains terms which differ from the Mozilla Public License and
1868. Netscape Public License. (Filling in the name of the Initial
1869. Developer, Original Code or Contributor in the notice described in
1870. Exhibit A shall not of themselves be deemed to be modifications of
  1871. this License.)
  1872. 7. DISCLAIMER OF WARRANTY.
1873. COVERED CODE IS PROVIDED UNDER THIS LICENSE ON AN "AS IS" BASIS,
1874. WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESSED OR IMPLIED, INCLUDING,
1875. WITHOUT LIMITATION, WARRANTIES THAT THE COVERED CODE IS FREE OF
1876. DEFECTS, MERCHANTABLE, FIT FOR A PARTICULAR PURPOSE OR NON-INFRINGING.
1877. THE ENTIRE RISK AS TO THE QUALITY AND PERFORMANCE OF THE COVERED CODE
1878. IS WITH YOU. SHOULD ANY COVERED CODE PROVE DEFECTIVE IN ANY RESPECT,
1879. YOU (NOT THE INITIAL DEVELOPER OR ANY OTHER CONTRIBUTOR) ASSUME THE
1880. COST OF ANY NECESSARY SERVICING, REPAIR OR CORRECTION. THIS DISCLAIMER
1881. OF WARRANTY CONSTITUTES AN ESSENTIAL PART OF THIS LICENSE. NO USE OF
1882. ANY COVERED CODE IS AUTHORIZED HEREUNDER EXCEPT UNDER THIS DISCLAIMER.
  1883. 8. TERMINATION.
1884. 8.1. This License and the rights granted hereunder will terminate
1885. automatically if You fail to comply with terms herein and fail to cure
1886. such breach within 30 days of becoming aware of the breach. All
1887. sublicenses to the Covered Code which are properly granted shall
1888. survive any termination of this License. Provisions which, by their
1889. nature, must remain in effect beyond the termination of this License
  1890. shall survive.
1891. 8.2. If You initiate litigation by asserting a patent infringement
1892. claim (excluding declatory judgment actions) against Initial Developer
1893. or a Contributor (the Initial Developer or Contributor against whom
1894. You file such action is referred to as "Participant") alleging that:
1895. (a) such Participant's Contributor Version directly or indirectly
1896. infringes any patent, then any and all rights granted by such
1897. Participant to You under Sections 2.1 and/or 2.2 of this License
1898. shall, upon 60 days notice from Participant terminate prospectively,
1899. unless if within 60 days after receipt of notice You either: (i)
1900. agree in writing to pay Participant a mutually agreeable reasonable
1901. royalty for Your past and future use of Modifications made by such
1902. Participant, or (ii) withdraw Your litigation claim with respect to
1903. the Contributor Version against such Participant. If within 60 days
1904. of notice, a reasonable royalty and payment arrangement are not
1905. mutually agreed upon in writing by the parties or the litigation claim
1906. is not withdrawn, the rights granted by Participant to You under
1907. Sections 2.1 and/or 2.2 automatically terminate at the expiration of
1908. the 60 day notice period specified above.
1909. (b) any software, hardware, or device, other than such Participant's
1910. Contributor Version, directly or indirectly infringes any patent, then
1911. any rights granted to You by such Participant under Sections 2.1(b)
1912. and 2.2(b) are revoked effective as of the date You first made, used,
1913. sold, distributed, or had made, Modifications made by that
  1914. Participant.
1915. 8.3. If You assert a patent infringement claim against Participant
1916. alleging that such Participant's Contributor Version directly or
1917. indirectly infringes any patent where such claim is resolved (such as
1918. by license or settlement) prior to the initiation of patent
1919. infringement litigation, then the reasonable value of the licenses
1920. granted by such Participant under Sections 2.1 or 2.2 shall be taken
1921. into account in determining the amount or value of any payment or
  1922. license.
1923. 8.4. In the event of termination under Sections 8.1 or 8.2 above,
1924. all end user license agreements (excluding distributors and resellers)
1925. which have been validly granted by You or any distributor hereunder
1926. prior to termination shall survive termination.
  1927. 9. LIMITATION OF LIABILITY.
1928. UNDER NO CIRCUMSTANCES AND UNDER NO LEGAL THEORY, WHETHER TORT
1929. (INCLUDING NEGLIGENCE), CONTRACT, OR OTHERWISE, SHALL YOU, THE INITIAL
1930. DEVELOPER, ANY OTHER CONTRIBUTOR, OR ANY DISTRIBUTOR OF COVERED CODE,
1931. OR ANY SUPPLIER OF ANY OF SUCH PARTIES, BE LIABLE TO ANY PERSON FOR
1932. ANY INDIRECT, SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGES OF ANY
1933. CHARACTER INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF GOODWILL,
1934. WORK STOPPAGE, COMPUTER FAILURE OR MALFUNCTION, OR ANY AND ALL OTHER
1935. COMMERCIAL DAMAGES OR LOSSES, EVEN IF SUCH PARTY SHALL HAVE BEEN
1936. INFORMED OF THE POSSIBILITY OF SUCH DAMAGES. THIS LIMITATION OF
1937. LIABILITY SHALL NOT APPLY TO LIABILITY FOR DEATH OR PERSONAL INJURY
1938. RESULTING FROM SUCH PARTY'S NEGLIGENCE TO THE EXTENT APPLICABLE LAW
1939. PROHIBITS SUCH LIMITATION. SOME JURISDICTIONS DO NOT ALLOW THE
1940. EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO
1941. THIS EXCLUSION AND LIMITATION MAY NOT APPLY TO YOU.
  1942. 10. U.S. GOVERNMENT END USERS.
1943. The Covered Code is a "commercial item," as that term is defined in
  1944. 48 C.F.R. 2.101 (Oct. 1995), consisting of "commercial computer
1945. software" and "commercial computer software documentation," as such
  1946. terms are used in 48 C.F.R. 12.212 (Sept. 1995). Consistent with 48
  1947. C.F.R. 12.212 and 48 C.F.R. 227.7202-1 through 227.7202-4 (June 1995),
1948. all U.S. Government End Users acquire Covered Code with only those
  1949. rights set forth herein.
  1950. 11. MISCELLANEOUS.
1951. This License represents the complete agreement concerning subject
1952. matter hereof. If any provision of this License is held to be
1953. unenforceable, such provision shall be reformed only to the extent
1954. necessary to make it enforceable. This License shall be governed by
1955. California law provisions (except to the extent applicable law, if
1956. any, provides otherwise), excluding its conflict-of-law provisions.
1957. With respect to disputes in which at least one party is a citizen of,
1958. or an entity chartered or registered to do business in the United
1959. States of America, any litigation relating to this License shall be
1960. subject to the jurisdiction of the Federal Courts of the Northern
1961. District of California, with venue lying in Santa Clara County,
1962. California, with the losing party responsible for costs, including
1963. without limitation, court costs and reasonable attorneys' fees and
1964. expenses. The application of the United Nations Convention on
1965. Contracts for the International Sale of Goods is expressly excluded.
1966. Any law or regulation which provides that the language of a contract
1967. shall be construed against the drafter shall not apply to this
  1968. License.
  1969. 12. RESPONSIBILITY FOR CLAIMS.
1970. As between Initial Developer and the Contributors, each party is
1971. responsible for claims and damages arising, directly or indirectly,
1972. out of its utilization of rights under this License and You agree to
1973. work with Initial Developer and Contributors to distribute such
1974. responsibility on an equitable basis. Nothing herein is intended or
1975. shall be deemed to constitute any admission of liability.
  1976. 13. MULTIPLE-LICENSED CODE.
1977. Initial Developer may designate portions of the Covered Code as
  1978. "Multiple-Licensed". "Multiple-Licensed" means that the Initial
1979. Developer permits you to utilize portions of the Covered Code under
1980. Your choice of the MPL or the alternative licenses, if any, specified
1981. by the Initial Developer in the file described in Exhibit A.
