  4. TERMS AND CONDITIONS FOR USE, REPRODUCTION, AND DISTRIBUTION
  5. 1. Definitions.
  6. "License" shall mean the terms and conditions for use, reproduction,
  7. and distribution as defined by Sections 1 through 9 of this document.
  8. "Licensor" shall mean the copyright owner or entity authorized by
  9. the copyright owner that is granting the License.
  10. "Legal Entity" shall mean the union of the acting entity and all
  11. other entities that control, are controlled by, or are under common
  12. control with that entity. For the purposes of this definition,
  13. "control" means (i) the power, direct or indirect, to cause the
  14. direction or management of such entity, whether by contract or
  15. otherwise, or (ii) ownership of fifty percent (50%) or more of the
  16. outstanding shares, or (iii) beneficial ownership of such entity.
  17. "You" (or "Your") shall mean an individual or Legal Entity
  18. exercising permissions granted by this License.
  19. "Source" form shall mean the preferred form for making modifications,
  20. including but not limited to software source code, documentation
  21. source, and configuration files.
  22. "Object" form shall mean any form resulting from mechanical
  23. transformation or translation of a Source form, including but
  24. not limited to compiled object code, generated documentation,
  25. and conversions to other media types.
  26. "Work" shall mean the work of authorship, whether in Source or
  27. Object form, made available under the License, as indicated by a
  28. copyright notice that is included in or attached to the work
  29. (an example is provided in the Appendix below).
  30. "Derivative Works" shall mean any work, whether in Source or Object
  31. form, that is based on (or derived from) the Work and for which the
  32. editorial revisions, annotations, elaborations, or other modifications
  33. represent, as a whole, an original work of authorship. For the purposes
  34. of this License, Derivative Works shall not include works that remain
  35. separable from, or merely link (or bind by name) to the interfaces of,
  36. the Work and Derivative Works thereof.
  37. "Contribution" shall mean any work of authorship, including
  38. the original version of the Work and any modifications or additions
  39. to that Work or Derivative Works thereof, that is intentionally
  40. submitted to Licensor for inclusion in the Work by the copyright owner
  41. or by an individual or Legal Entity authorized to submit on behalf of
  42. the copyright owner. For the purposes of this definition, "submitted"
  43. means any form of electronic, verbal, or written communication sent
  44. to the Licensor or its representatives, including but not limited to
  45. communication on electronic mailing lists, source code control systems,
  46. and issue tracking systems that are managed by, or on behalf of, the
  47. Licensor for the purpose of discussing and improving the Work, but
  48. excluding communication that is conspicuously marked or otherwise
  49. designated in writing by the copyright owner as "Not a Contribution."
  50. "Contributor" shall mean Licensor and any individual or Legal Entity
  51. on behalf of whom a Contribution has been received by Licensor and
  52. subsequently incorporated within the Work.
  53. 2. Grant of Copyright License. Subject to the terms and conditions of
  54. this License, each Contributor hereby grants to You a perpetual,
  55. worldwide, non-exclusive, no-charge, royalty-free, irrevocable
  56. copyright license to reproduce, prepare Derivative Works of,
  57. publicly display, publicly perform, sublicense, and distribute the
  58. Work and such Derivative Works in Source or Object form.
  59. 3. Grant of Patent License. Subject to the terms and conditions of
  60. this License, each Contributor hereby grants to You a perpetual,
  61. worldwide, non-exclusive, no-charge, royalty-free, irrevocable
  62. (except as stated in this section) patent license to make, have made,
  63. use, offer to sell, sell, import, and otherwise transfer the Work,
  64. where such license applies only to those patent claims licensable
  65. by such Contributor that are necessarily infringed by their
  66. Contribution(s) alone or by combination of their Contribution(s)
  67. with the Work to which such Contribution(s) was submitted. If You
  68. institute patent litigation against any entity (including a
  69. cross-claim or counterclaim in a lawsuit) alleging that the Work
  70. or a Contribution incorporated within the Work constitutes direct
  71. or contributory patent infringement, then any patent licenses
  72. granted to You under this License for that Work shall terminate
  73. as of the date such litigation is filed.
  74. 4. Redistribution. You may reproduce and distribute copies of the
  75. Work or Derivative Works thereof in any medium, with or without
  76. modifications, and in Source or Object form, provided that You
  77. meet the following conditions:
  78. (a) You must give any other recipients of the Work or
  79. Derivative Works a copy of this License; and
  80. (b) You must cause any modified files to carry prominent notices
  81. stating that You changed the files; and
  82. (c) You must retain, in the Source form of any Derivative Works
  83. that You distribute, all copyright, patent, trademark, and
  84. attribution notices from the Source form of the Work,
  85. excluding those notices that do not pertain to any part of
  86. the Derivative Works; and
  87. (d) If the Work includes a "NOTICE" text file as part of its
  88. distribution, then any Derivative Works that You distribute must
  89. include a readable copy of the attribution notices contained
  90. within such NOTICE file, excluding those notices that do not
  91. pertain to any part of the Derivative Works, in at least one
  92. of the following places: within a NOTICE text file distributed
  93. as part of the Derivative Works; within the Source form or
  94. documentation, if provided along with the Derivative Works; or,
  95. within a display generated by the Derivative Works, if and
  96. wherever such third-party notices normally appear. The contents

  712. Code. Any Covered Software that You distribute or otherwise make available in
  713. Executable form must also be made available in Source Code form and that Source
  714. Code form must be distributed only under the terms of this License. You must
  715. include a copy of this License with every copy of the Source Code form of the
  716. Covered Software You distribute or otherwise make available. You must inform
  717. recipients of any such Covered Software in Executable form as to how they can
  718. obtain such Covered Software in Source Code form in a reasonable manner on or
  719. through a medium customarily used for software exchange.
  720. 3.2.
  721. Modifications. The Modifications that You create or to which You contribute are
  722. governed by the terms of this License. You represent that You believe Your
  723. Modifications are Your original creation(s) and/or You have sufficient rights to
  724. grant the rights conveyed by this License.
  725. 3.3. Required Notices. You must
  726. include a notice in each of Your Modifications that identifies You as the
  727. Contributor of the Modification. You may not remove or alter any copyright,
  728. patent or trademark notices contained within the Covered Software, or any
  729. notices of licensing or any descriptive text giving attribution to any
  730. Contributor or the Initial Developer.
  731. 3.4. Application of Additional Terms.
  732. You may not offer or impose any terms on any Covered Software in Source Code
  733. form that alters or restricts the applicable version of this License or the
  734. recipients rights hereunder. You may choose to offer, and to charge a fee for,
  735. warranty, support, indemnity or liability obligations to one or more recipients
  736. of Covered Software. However, you may do so only on Your own behalf, and not on
  737. behalf of the Initial Developer or any Contributor. You must make it absolutely
  738. clear that any such warranty, support, indemnity or liability obligation is
  739. offered by You alone, and You hereby agree to indemnify the Initial Developer
  740. and every Contributor for any liability incurred by the Initial Developer or
  741. such Contributor as a result of warranty, support, indemnity or liability terms
  742. You offer.
  743. 3.5. Distribution of Executable Versions. You may distribute the
  744. Executable form of the Covered Software under the terms of this License or under
  745. the terms of a license of Your choice, which may contain terms different from
  746. this License, provided that You are in compliance with the terms of this License
  747. and that the license for the Executable form does not attempt to limit or alter
  748. the recipients rights in the Source Code form from the rights set forth in this
  749. License. If You distribute the Covered Software in Executable form under a
  750. different license, You must make it absolutely clear that any terms which differ
  751. from this License are offered by You alone, not by the Initial Developer or
  752. Contributor. You hereby agree to indemnify the Initial Developer and every
  753. Contributor for any liability incurred by the Initial Developer or such
  754. Contributor as a result of any such terms You offer.
  755. 3.6. Larger Works. You
  756. may create a Larger Work by combining Covered Software with other code not
  757. governed by the terms of this License and distribute the Larger Work as a single
  758. product. In such a case, You must make sure the requirements of this License are
  759. fulfilled for the Covered Software.
  760. 4. Versions of the License.
  761. 4.1.
  762. New Versions. Sun Microsystems, Inc. is the initial license steward and may
  763. publish revised and/or new versions of this License from time to time. Each
  764. version will be given a distinguishing version number. Except as provided in
  765. Section 4.3, no one other than the license steward has the right to modify this
  766. License.
  767. 4.2. Effect of New Versions. You may always continue to use,
  768. distribute or otherwise make the Covered Software available under the terms of
  769. the version of the License under which You originally received the Covered
  770. Software. If the Initial Developer includes a notice in the Original Software
  771. prohibiting it from being distributed or otherwise made available under any
  772. subsequent version of the License, You must distribute and make the Covered
  773. Software available under the terms of the version of the License under which You
  774. originally received the Covered Software. Otherwise, You may also choose to use,
  775. distribute or otherwise make the Covered Software available under the terms of
  776. any subsequent version of the License published by the license
  777. steward.
  778. 4.3. Modified Versions. When You are an Initial Developer and You
  779. want to create a new license for Your Original Software, You may create and use
  780. a modified version of this License if You: (a) rename the license and remove
  781. any references to the name of the license steward (except to note that the
  782. license differs from this License); and (b) otherwise make it clear that the
  783. license contains terms which differ from this License.
  784. 5. DISCLAIMER OF WARRANTY.
  785. COVERED SOFTWARE IS PROVIDED UNDER THIS LICENSE ON AN AS IS BASIS,
  786. WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESSED OR IMPLIED, INCLUDING, WITHOUT
  787. LIMITATION, WARRANTIES THAT THE COVERED SOFTWARE IS FREE OF DEFECTS,
  788. MERCHANTABLE, FIT FOR A PARTICULAR PURPOSE OR NON-INFRINGING. THE ENTIRE RISK AS
  789. TO THE QUALITY AND PERFORMANCE OF THE COVERED SOFTWARE IS WITH YOU. SHOULD ANY
  790. COVERED SOFTWARE PROVE DEFECTIVE IN ANY RESPECT, YOU (NOT THE INITIAL DEVELOPER
  791. OR ANY OTHER CONTRIBUTOR) ASSUME THE COST OF ANY NECESSARY SERVICING, REPAIR OR
  792. CORRECTION. THIS DISCLAIMER OF WARRANTY CONSTITUTES AN ESSENTIAL PART OF THIS
  793. LICENSE. NO USE OF ANY COVERED SOFTWARE IS AUTHORIZED HEREUNDER EXCEPT UNDER
  794. THIS DISCLAIMER.
  795. 6. TERMINATION.
  796. 6.1. This License and the rights
  797. granted hereunder will terminate automatically if You fail to comply with terms
  798. herein and fail to cure such breach within 30 days of becoming aware of the
  799. breach. Provisions which, by their nature, must remain in effect beyond the
  800. termination of this License shall survive.
  801. 6.2. If You assert a patent
  802. infringement claim (excluding declaratory judgment actions) against Initial
  803. Developer or a Contributor (the Initial Developer or Contributor against whom
  804. You assert such claim is referred to as Participant) alleging that the
  805. Participant Software (meaning the Contributor Version where the Participant is a
  806. Contributor or the Original Software where the Participant is the Initial
  807. Developer) directly or indirectly infringes any patent, then any and all rights
  808. granted directly or indirectly to You by such Participant, the Initial Developer
  809. (if the Initial Developer is not the Participant) and all Contributors under
  810. Sections 2.1 and/or 2.2 of this License shall, upon 60 days notice from
  811. Participant terminate prospectively and automatically at the expiration of such
  812. 60 day notice period, unless if within such 60 day period You withdraw Your
  813. claim with respect to the Participant Software against such Participant either
  814. unilaterally or pursuant to a written agreement with Participant.
  815. 6.3. In
  816. the event of termination under Sections 6.1 or 6.2 above, all end user licenses
  817. that have been validly granted by You or any distributor hereunder prior to
  818. termination (excluding licenses granted to You by any distributor) shall survive
  819. termination.
  820. 7. LIMITATION OF LIABILITY.
  821. UNDER NO CIRCUMSTANCES AND UNDER
  822. NO LEGAL THEORY, WHETHER TORT (INCLUDING NEGLIGENCE), CONTRACT, OR OTHERWISE,
  823. SHALL YOU, THE INITIAL DEVELOPER, ANY OTHER CONTRIBUTOR, OR ANY DISTRIBUTOR OF
  824. COVERED SOFTWARE, OR ANY SUPPLIER OF ANY OF SUCH PARTIES, BE LIABLE TO ANY
  825. PERSON FOR ANY INDIRECT, SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGES OF ANY
  826. CHARACTER INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOST PROFITS, LOSS OF
  827. GOODWILL, WORK STOPPAGE, COMPUTER FAILURE OR MALFUNCTION, OR ANY AND ALL OTHER
  828. COMMERCIAL DAMAGES OR LOSSES, EVEN IF SUCH PARTY SHALL HAVE BEEN INFORMED OF THE
  829. POSSIBILITY OF SUCH DAMAGES. THIS LIMITATION OF LIABILITY SHALL NOT APPLY TO
  830. LIABILITY FOR DEATH OR PERSONAL INJURY RESULTING FROM SUCH PARTYS NEGLIGENCE TO
  831. THE EXTENT APPLICABLE LAW PROHIBITS SUCH LIMITATION. SOME JURISDICTIONS DO NOT
  832. ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO
  833. THIS EXCLUSION AND LIMITATION MAY NOT APPLY TO YOU.
  834. 8. U.S. GOVERNMENT END USERS.
  835. The Covered Software is a commercial item, as that term is defined in
  836. 48 C.F.R. 2.101 (Oct. 1995), consisting of commercial computer software (as
  837. that term is defined at 48 C.F.R.  252.227-7014(a)(1)) and commercial computer
  838. software documentation as such terms are used in 48 C.F.R. 12.212 (Sept.
  839. 1995). Consistent with 48 C.F.R. 12.212 and 48 C.F.R. 227.7202-1 through
  840. 227.7202-4 (June 1995), all U.S. Government End Users acquire Covered Software
  841. with only those rights set forth herein. This U.S. Government Rights clause is
  842. in lieu of, and supersedes, any other FAR, DFAR, or other clause or provision
  843. that addresses Government rights in computer software under this
  844. License.
  845. 9. MISCELLANEOUS.
  846. This License represents the complete agreement
  847. concerning subject matter hereof. If any provision of this License is held to be
  848. unenforceable, such provision shall be reformed only to the extent necessary to
  849. make it enforceable. This License shall be governed by the law of the
  850. jurisdiction specified in a notice contained within the Original Software
  851. (except to the extent applicable law, if any, provides otherwise), excluding
  852. such jurisdictions conflict-of-law provisions. Any litigation relating to this
  853. License shall be subject to the jurisdiction of the courts located in the
  854. jurisdiction and venue specified in a notice contained within the Original
  855. Software, with the losing party responsible for costs, including, without
  856. limitation, court costs and reasonable attorneys fees and expenses. The
  857. application of the United Nations Convention on Contracts for the International
  858. Sale of Goods is expressly excluded. Any law or regulation which provides that
  859. the language of a contract shall be construed against the drafter shall not
  860. apply to this License. You agree that You alone are responsible for compliance
  861. with the United States export administration regulations (and the export control
  862. laws and regulation of any other countries) when You use, distribute or
  863. otherwise make available any Covered Software.
  864. 10. RESPONSIBILITY FOR CLAIMS.
  865. As between Initial Developer and the Contributors, each party is
  866. responsible for claims and damages arising, directly or indirectly, out of its
  867. utilization of rights under this License and You agree to work with Initial
  868. Developer and Contributors to distribute such responsibility on an equitable
  869. basis. Nothing herein is intended or shall be deemed to constitute any admission

  884. 1.3. “Covered Software” means (a) the Original Software, or (b)
  885. Modifications, or (c) the combination of files containing Original Software with
  886. files containing Modifications, in each case including portions thereof.
  887. 1.4. “Executable” means the Covered Software in any form other than Source
  888. Code.
  889. 1.5. “Initial Developer” means the individual or entity that first makes
  890. Original Software available under this License.
  891. 1.6. “Larger Work” means a work which combines Covered Software or portions

  893. 1.7. “License” means this document.
  894. 1.8. “Licensable” means having the right to grant, to the maximum extent
  895. possible, whether at the time of the initial grant or subsequently acquired, any
  896. and all of the rights conveyed herein.
  897. 1.9. “Modifications” means the Source Code and Executable form of any of the
  898. following:
  899. A. Any file that results from an addition to, deletion from or modification of
  900. the contents of a file containing Original Software or previous Modifications;
  901. B. Any new file that contains any part of the Original Software or previous

  911. which modifications are made and (b) associated documentation included in or
  912. with such code.
  913. 1.13. “You” (or “Your”) means an individual or a legal entity exercising
  914. rights under, and complying with all of the terms of, this License. For legal
  915. entities, “You” includes any entity which controls, is controlled by, or is
  916. under common control with You. For purposes of this definition, “control”
  917. means (a) the power, direct or indirect, to cause the direction or management of
  918. such entity, whether by contract or otherwise, or (b) ownership of more than
  919. fifty percent (50%) of the outstanding shares or beneficial ownership of such

  921. 2. License Grants.
  922. 2.1. The Initial Developer Grant.
  923. Conditioned upon Your compliance with Section 3.1 below and subject to
  924. third party intellectual property claims, the Initial Developer hereby grants
  925. You a world-wide, royalty-free, non-exclusive license:
  926. (a) under intellectual
  927. property rights (other than patent or trademark) Licensable by Initial
  928. Developer, to use, reproduce, modify, display, perform, sublicense and
  929. distribute the Original Software (or portions thereof), with or without
  930. Modifications, and/or as part of a Larger Work; and
  931. (b) under Patent Claims
  932. infringed by the making, using or selling of Original Software, to make, have
  933. made, use, practice, sell, and offer for sale, and/or otherwise dispose of the
  934. Original Software (or portions thereof).
  935. (c) The licenses granted in Sections
  936. 2.1(a) and (b) are effective on the date Initial Developer first distributes or
  937. otherwise makes the Original Software available to a third party under the terms
  938. of this License.
  939. (d) Notwithstanding Section 2.1(b) above, no patent license is
  940. granted: (1) for code that You delete from the Original Software, or (2) for
  941. infringements caused by: (i) the modification of the Original Software, or (ii)
  942. the combination of the Original Software with other software or devices.
  943. 2.2. Contributor Grant.
  944. Conditioned upon Your compliance with Section 3.1 below and
  945. subject to third party intellectual property claims, each Contributor hereby
  946. grants You a world-wide, royalty-free, non-exclusive license:
  947. (a) under
  948. intellectual property rights (other than patent or trademark) Licensable by
  949. Contributor to use, reproduce, modify, display, perform, sublicense and
  950. distribute the Modifications created by such Contributor (or portions thereof),

  952. and/or as part of a Larger Work; and
  953. (b) under Patent Claims infringed by the
  954. making, using, or selling of Modifications made by that Contributor either alone
  955. and/or in combination with its Contributor Version (or portions of such
  956. combination), to make, use, sell, offer for sale, have made, and/or otherwise
  957. dispose of: (1) Modifications made by that Contributor (or portions thereof);
  958. and (2) the combination of Modifications made by that Contributor with its
  959. Contributor Version (or portions of such combination).
  960. (c) The licenses granted
  961. in Sections 2.2(a) and 2.2(b) are effective on the date Contributor first
  962. distributes or otherwise makes the Modifications available to a third
  963. party.
  964. (d) Notwithstanding Section 2.2(b) above, no patent license is granted:
  965. (1) for any code that Contributor has deleted from the Contributor Version; (2)
  966. for infringements caused by: (i) third party modifications of Contributor
  967. Version, or (ii) the combination of Modifications made by that Contributor with
  968. other software (except as part of the Contributor Version) or other devices; or
  969. (3) under Patent Claims infringed by Covered Software in the absence of
  970. Modifications made by that Contributor.
  971. 3. Distribution Obligations.
  972. 3.1. Availability of Source Code.
  973. Any Covered Software that You distribute or
  974. otherwise make available in Executable form must also be made available in
  975. Source Code form and that Source Code form must be distributed only under the
  976. terms of this License. You must include a copy of this License with every copy
  977. of the Source Code form of the Covered Software You distribute or otherwise make
  978. available. You must inform recipients of any such Covered Software in Executable
  979. form as to how they can obtain such Covered Software in Source Code form in a
  980. reasonable manner on or through a medium customarily used for software
  981. exchange.
  982. 3.2. Modifications.
  983. The Modifications that You create or to which
  984. You contribute are governed by the terms of this License. You represent that You
  985. believe Your Modifications are Your original creation(s) and/or You have
  986. sufficient rights to grant the rights conveyed by this License.
  987. 3.3. Required Notices.
  988. You must include a notice in each of Your Modifications that
  989. identifies You as the Contributor of the Modification. You may not remove or
  990. alter any copyright, patent or trademark notices contained within the Covered
  991. Software, or any notices of licensing or any descriptive text giving attribution
  992. to any Contributor or the Initial Developer.
  993. 3.4. Application of Additional Terms.
  994. You may not offer or impose any terms on any Covered Software in Source
  995. Code form that alters or restricts the applicable version of this License or the
  996. recipients' rights hereunder. You may choose to offer, and to charge a fee for,
  997. warranty, support, indemnity or liability obligations to one or more recipients
  998. of Covered Software. However, you may do so only on Your own behalf, and not on
  999. behalf of the Initial Developer or any Contributor. You must make it absolutely
1000. clear that any such warranty, support, indemnity or liability obligation is
1001. offered by You alone, and You hereby agree to indemnify the Initial Developer
1002. and every Contributor for any liability incurred by the Initial Developer or
1003. such Contributor as a result of warranty, support, indemnity or liability terms
  1004. You offer.
1005. 3.5. Distribution of Executable Versions.
  1006. You may distribute the
1007. Executable form of the Covered Software under the terms of this License or under
1008. the terms of a license of Your choice, which may contain terms different from
1009. this License, provided that You are in compliance with the terms of this License
1010. and that the license for the Executable form does not attempt to limit or alter
1011. the recipient's rights in the Source Code form from the rights set forth in
1012. this License. If You distribute the Covered Software in Executable form under a
1013. different license, You must make it absolutely clear that any terms which differ
1014. from this License are offered by You alone, not by the Initial Developer or
1015. Contributor. You hereby agree to indemnify the Initial Developer and every
1016. Contributor for any liability incurred by the Initial Developer or such
1017. Contributor as a result of any such terms You offer.
  1018. 3.6. Larger Works.
  1019. You
1020. may create a Larger Work by combining Covered Software with other code not
1021. governed by the terms of this License and distribute the Larger Work as a single
1022. product. In such a case, You must make sure the requirements of this License are
1023. fulfilled for the Covered Software.
1024. 4. Versions of the License.
  1025. 4.1. New Versions.
1026. Oracle is the initial license steward and may publish revised and/or
1027. new versions of this License from time to time. Each version will be given a
1028. distinguishing version number. Except as provided in Section 4.3, no one other
1029. than the license steward has the right to modify this License.
1030. 4.2. Effect of New Versions.
1031. You may always continue to use, distribute or otherwise make the
1032. Covered Software available under the terms of the version of the License under
1033. which You originally received the Covered Software. If the Initial Developer
1034. includes a notice in the Original Software prohibiting it from being distributed
1035. or otherwise made available under any subsequent version of the License, You
1036. must distribute and make the Covered Software available under the terms of the
1037. version of the License under which You originally received the Covered Software.
1038. Otherwise, You may also choose to use, distribute or otherwise make the Covered
1039. Software available under the terms of any subsequent version of the License
1040. published by the license steward.
  1041. 4.3. Modified Versions.
  1042. When You are an
1043. Initial Developer and You want to create a new license for Your Original
1044. Software, You may create and use a modified version of this License if You: (a)
1045. rename the license and remove any references to the name of the license steward
1046. (except to note that the license differs from this License); and (b) otherwise
1047. make it clear that the license contains terms which differ from this
  1048. License.
  1049. 5. DISCLAIMER OF WARRANTY.
1050. COVERED SOFTWARE IS PROVIDED UNDER THIS
1051. LICENSE ON AN “AS IS” BASIS, WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESSED
1052. OR IMPLIED, INCLUDING, WITHOUT LIMITATION, WARRANTIES THAT THE COVERED SOFTWARE
1053. IS FREE OF DEFECTS, MERCHANTABLE, FIT FOR A PARTICULAR PURPOSE OR
1054. NON-INFRINGING. THE ENTIRE RISK AS TO THE QUALITY AND PERFORMANCE OF THE COVERED
1055. SOFTWARE IS WITH YOU. SHOULD ANY COVERED SOFTWARE PROVE DEFECTIVE IN ANY
1056. RESPECT, YOU (NOT THE INITIAL DEVELOPER OR ANY OTHER CONTRIBUTOR) ASSUME THE
1057. COST OF ANY NECESSARY SERVICING, REPAIR OR CORRECTION. THIS DISCLAIMER OF
1058. WARRANTY CONSTITUTES AN ESSENTIAL PART OF THIS LICENSE. NO USE OF ANY COVERED
1059. SOFTWARE IS AUTHORIZED HEREUNDER EXCEPT UNDER THIS DISCLAIMER.
  1060. 6. TERMINATION.
1061. 6.1. This License and the rights granted hereunder will
1062. terminate automatically if You fail to comply with terms herein and fail to cure
1063. such breach within 30 days of becoming aware of the breach. Provisions which, by
1064. their nature, must remain in effect beyond the termination of this License shall
  1065. survive.
1066. 6.2. If You assert a patent infringement claim (excluding declaratory
1067. judgment actions) against Initial Developer or a Contributor (the Initial
1068. Developer or Contributor against whom You assert such claim is referred to as
1069. “Participant”) alleging that the Participant Software (meaning the
1070. Contributor Version where the Participant is a Contributor or the Original
1071. Software where the Participant is the Initial Developer) directly or indirectly
1072. infringes any patent, then any and all rights granted directly or indirectly to
1073. You by such Participant, the Initial Developer (if the Initial Developer is not
1074. the Participant) and all Contributors under Sections 2.1 and/or 2.2 of this
1075. License shall, upon 60 days notice from Participant terminate prospectively and
1076. automatically at the expiration of such 60 day notice period, unless if within
1077. such 60 day period You withdraw Your claim with respect to the Participant
1078. Software against such Participant either unilaterally or pursuant to a written
  1079. agreement with Participant.
1080. 6.3. If You assert a patent infringement claim
1081. against Participant alleging that the Participant Software directly or
1082. indirectly infringes any patent where such claim is resolved (such as by license
1083. or settlement) prior to the initiation of patent infringement litigation, then
1084. the reasonable value of the licenses granted by such Participant under Sections
1085. 2.1 or 2.2 shall be taken into account in determining the amount or value of any
  1086. payment or license.
1087. 6.4. In the event of termination under Sections 6.1 or 6.2
1088. above, all end user licenses that have been validly granted by You or any
1089. distributor hereunder prior to termination (excluding licenses granted to You by
1090. any distributor) shall survive termination.
  1091. 7. LIMITATION OF LIABILITY.
1092. UNDER NO CIRCUMSTANCES AND UNDER NO LEGAL THEORY, WHETHER TORT
1093. (INCLUDING NEGLIGENCE), CONTRACT, OR OTHERWISE, SHALL YOU, THE INITIAL
1094. DEVELOPER, ANY OTHER CONTRIBUTOR, OR ANY DISTRIBUTOR OF COVERED SOFTWARE, OR ANY
1095. SUPPLIER OF ANY OF SUCH PARTIES, BE LIABLE TO ANY PERSON FOR ANY INDIRECT,
1096. SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGES OF ANY CHARACTER INCLUDING,
1097. WITHOUT LIMITATION, DAMAGES FOR LOSS OF GOODWILL, WORK STOPPAGE, COMPUTER
1098. FAILURE OR MALFUNCTION, OR ANY AND ALL OTHER COMMERCIAL DAMAGES OR LOSSES, EVEN
1099. IF SUCH PARTY SHALL HAVE BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGES. THIS
1100. LIMITATION OF LIABILITY SHALL NOT APPLY TO LIABILITY FOR DEATH OR PERSONAL
1101. INJURY RESULTING FROM SUCH PARTY'S NEGLIGENCE TO THE EXTENT APPLICABLE LAW
1102. PROHIBITS SUCH LIMITATION. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR
1103. LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THIS EXCLUSION AND
1104. LIMITATION MAY NOT APPLY TO YOU.
  1105. 8. U.S. GOVERNMENT END USERS.
  1106. The Covered
1107. Software is a “commercial item,” as that term is defined in 48 C.F.R. 2.101
1108. (Oct. 1995), consisting of “commercial computer software” (as that term is
  1109. defined at 48 C.F.R. § 252.227-7014(a)(1)) and “commercial computer software
1110. documentation” as such terms are used in 48 C.F.R. 12.212 (Sept. 1995).
  1111. Consistent with 48 C.F.R. 12.212 and 48 C.F.R. 227.7202-1 through 227.7202-4
1112. (June 1995), all U.S. Government End Users acquire Covered Software with only
1113. those rights set forth herein. This U.S. Government Rights clause is in lieu of,
1114. and supersedes, any other FAR, DFAR, or other clause or provision that addresses
1115. Government rights in computer software under this License.
  1116. 9. MISCELLANEOUS.
1117. This License represents the complete agreement concerning
1118. subject matter hereof. If any provision of this License is held to be
1119. unenforceable, such provision shall be reformed only to the extent necessary to
1120. make it enforceable. This License shall be governed by the law of the
1121. jurisdiction specified in a notice contained within the Original Software
1122. (except to the extent applicable law, if any, provides otherwise), excluding
1123. such jurisdiction's conflict-of-law provisions. Any litigation relating to this
1124. License shall be subject to the jurisdiction of the courts located in the
1125. jurisdiction and venue specified in a notice contained within the Original
1126. Software, with the losing party responsible for costs, including, without
1127. limitation, court costs and reasonable attorneys' fees and expenses. The
1128. application of the United Nations Convention on Contracts for the International
1129. Sale of Goods is expressly excluded. Any law or regulation which provides that
1130. the language of a contract shall be construed against the drafter shall not
1131. apply to this License. You agree that You alone are responsible for compliance
1132. with the United States export administration regulations (and the export control
1133. laws and regulation of any other countries) when You use, distribute or
1134. otherwise make available any Covered Software.
  1135. 10. RESPONSIBILITY FOR CLAIMS.
1136. As between Initial Developer and the Contributors, each party is
1137. responsible for claims and damages arising, directly or indirectly, out of its
1138. utilization of rights under this License and You agree to work with Initial
1139. Developer and Contributors to distribute such responsibility on an equitable
1140. basis. Nothing herein is intended or shall be deemed to constitute any admission
  1141. of liability.

1205. THE ACCOMPANYING PROGRAM IS PROVIDED UNDER THE TERMS OF THIS ECLIPSE PUBLIC
1206. LICENSE ("AGREEMENT"). ANY USE, REPRODUCTION OR DISTRIBUTION OF THE PROGRAM
1207. CONSTITUTES RECIPIENT'S ACCEPTANCE OF THIS AGREEMENT.
  1208. 1. DEFINITIONS
  1209. "Contribution" means:
1210. a) in the case of the initial Contributor, the initial code and documentation
1211. distributed under this Agreement, and
1212. b) in the case of each subsequent Contributor:
1213. i) changes to the Program, and
  1214. ii) additions to the Program;
1215. where such changes and/or additions to the Program originate from and are
1216. distributed by that particular Contributor. A Contribution 'originates' from a
1217. Contributor if it was added to the Program by such Contributor itself or anyone
1218. acting on such Contributor's behalf. Contributions do not include additions to
1219. the Program which: (i) are separate modules of software distributed in
1220. conjunction with the Program under their own license agreement, and (ii) are not
1221. derivative works of the Program.
1222. "Contributor" means any person or entity that distributes the Program.
1223. "Licensed Patents" mean patent claims licensable by a Contributor which are
1224. necessarily infringed by the use or sale of its Contribution alone or when
  1225. combined with the Program.
1226. "Program" means the Contributions distributed in accordance with this Agreement.
1227. "Recipient" means anyone who receives the Program under this Agreement,
  1228. including all Contributors.
  1229. 2. GRANT OF RIGHTS
1230. a) Subject to the terms of this Agreement, each Contributor hereby grants
  1231. Recipient a non-exclusive, worldwide, royalty-free copyright license to
1232. reproduce, prepare derivative works of, publicly display, publicly perform,
1233. distribute and sublicense the Contribution of such Contributor, if any, and such
1234. derivative works, in source code and object code form.
1235. b) Subject to the terms of this Agreement, each Contributor hereby grants
1236. Recipient a non-exclusive, worldwide, royalty-free patent license under Licensed
1237. Patents to make, use, sell, offer to sell, import and otherwise transfer the
1238. Contribution of such Contributor, if any, in source code and object code form.
1239. This patent license shall apply to the combination of the Contribution and the
1240. Program if, at the time the Contribution is added by the Contributor, such
1241. addition of the Contribution causes such combination to be covered by the
1242. Licensed Patents. The patent license shall not apply to any other combinations
1243. which include the Contribution. No hardware per se is licensed hereunder.
1244. c) Recipient understands that although each Contributor grants the licenses to
1245. its Contributions set forth herein, no assurances are provided by any
1246. Contributor that the Program does not infringe the patent or other intellectual
1247. property rights of any other entity. Each Contributor disclaims any liability to
1248. Recipient for claims brought by any other entity based on infringement of
1249. intellectual property rights or otherwise. As a condition to exercising the
1250. rights and licenses granted hereunder, each Recipient hereby assumes sole
1251. responsibility to secure any other intellectual property rights needed, if any.
1252. For example, if a third party patent license is required to allow Recipient to
1253. distribute the Program, it is Recipient's responsibility to acquire that license
  1254. before distributing the Program.
1255. d) Each Contributor represents that to its knowledge it has sufficient copyright
1256. rights in its Contribution, if any, to grant the copyright license set forth in
  1257. this Agreement.
  1258. 3. REQUIREMENTS
1259. A Contributor may choose to distribute the Program in object code form under its
1260. own license agreement, provided that:
1261. a) it complies with the terms and conditions of this Agreement; and
  1262. b) its license agreement:
1263. i) effectively disclaims on behalf of all Contributors all warranties and
1264. conditions, express and implied, including warranties or conditions of title and
1265. non-infringement, and implied warranties or conditions of merchantability and
  1266. fitness for a particular purpose;
1267. ii) effectively excludes on behalf of all Contributors all liability for
1268. damages, including direct, indirect, special, incidental and consequential
  1269. damages, such as lost profits;
1270. iii) states that any provisions which differ from this Agreement are offered by
1271. that Contributor alone and not by any other party; and
1272. iv) states that source code for the Program is available from such Contributor,
1273. and informs licensees how to obtain it in a reasonable manner on or through a
1274. medium customarily used for software exchange.
1275. When the Program is made available in source code form:
1276. a) it must be made available under this Agreement; and
1277. b) a copy of this Agreement must be included with each copy of the Program.
1278. Contributors may not remove or alter any copyright notices contained within the
  1279. Program.
1280. Each Contributor must identify itself as the originator of its Contribution, if
1281. any, in a manner that reasonably allows subsequent Recipients to identify the
  1282. originator of the Contribution.
  1283. 4. COMMERCIAL DISTRIBUTION
1284. Commercial distributors of software may accept certain responsibilities with
1285. respect to end users, business partners and the like. While this license is
1286. intended to facilitate the commercial use of the Program, the Contributor who
1287. includes the Program in a commercial product offering should do so in a manner
1288. which does not create potential liability for other Contributors. Therefore, if
1289. a Contributor includes the Program in a commercial product offering, such
1290. Contributor ("Commercial Contributor") hereby agrees to defend and indemnify
1291. every other Contributor ("Indemnified Contributor") against any losses, damages
1292. and costs (collectively "Losses") arising from claims, lawsuits and other legal
1293. actions brought by a third party against the Indemnified Contributor to the
1294. extent caused by the acts or omissions of such Commercial Contributor in
1295. connection with its distribution of the Program in a commercial product
1296. offering. The obligations in this section do not apply to any claims or Losses
1297. relating to any actual or alleged intellectual property infringement. In order
1298. to qualify, an Indemnified Contributor must: a) promptly notify the Commercial
1299. Contributor in writing of such claim, and b) allow the Commercial Contributor to
1300. control, and cooperate with the Commercial Contributor in, the defense and any
1301. related settlement negotiations. The Indemnified Contributor may participate in
1302. any such claim at its own expense.
1303. For example, a Contributor might include the Program in a commercial product
1304. offering, Product X. That Contributor is then a Commercial Contributor. If that
1305. Commercial Contributor then makes performance claims, or offers warranties
1306. related to Product X, those performance claims and warranties are such
1307. Commercial Contributor's responsibility alone. Under this section, the
1308. Commercial Contributor would have to defend claims against the other
1309. Contributors related to those performance claims and warranties, and if a court
1310. requires any other Contributor to pay any damages as a result, the Commercial
1311. Contributor must pay those damages.
  1312. 5. NO WARRANTY
1313. EXCEPT AS EXPRESSLY SET FORTH IN THIS AGREEMENT, THE PROGRAM IS PROVIDED ON AN
1314. "AS IS" BASIS, WITHOUT WARRANTIES OR CONDITIONS OF ANY KIND, EITHER EXPRESS OR
1315. IMPLIED INCLUDING, WITHOUT LIMITATION, ANY WARRANTIES OR CONDITIONS OF TITLE,
1316. NON-INFRINGEMENT, MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. Each
1317. Recipient is solely responsible for determining the appropriateness of using and
1318. distributing the Program and assumes all risks associated with its exercise of
1319. rights under this Agreement , including but not limited to the risks and costs
1320. of program errors, compliance with applicable laws, damage to or loss of data,
1321. programs or equipment, and unavailability or interruption of operations.
  1322. 6. DISCLAIMER OF LIABILITY
1323. EXCEPT AS EXPRESSLY SET FORTH IN THIS AGREEMENT, NEITHER RECIPIENT NOR ANY
1324. CONTRIBUTORS SHALL HAVE ANY LIABILITY FOR ANY DIRECT, INDIRECT, INCIDENTAL,
1325. SPECIAL, EXEMPLARY, OR CONSEQUENTIAL DAMAGES (INCLUDING WITHOUT LIMITATION LOST
1326. PROFITS), HOWEVER CAUSED AND ON ANY THEORY OF LIABILITY, WHETHER IN CONTRACT,
1327. STRICT LIABILITY, OR TORT (INCLUDING NEGLIGENCE OR OTHERWISE) ARISING IN ANY WAY
1328. OUT OF THE USE OR DISTRIBUTION OF THE PROGRAM OR THE EXERCISE OF ANY RIGHTS
1329. GRANTED HEREUNDER, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
  1330. 7. GENERAL
1331. If any provision of this Agreement is invalid or unenforceable under applicable
1332. law, it shall not affect the validity or enforceability of the remainder of the
1333. terms of this Agreement, and without further action by the parties hereto, such
1334. provision shall be reformed to the minimum extent necessary to make such
  1335. provision valid and enforceable.
1336. If Recipient institutes patent litigation against any entity (including a
1337. cross-claim or counterclaim in a lawsuit) alleging that the Program itself
1338. (excluding combinations of the Program with other software or hardware)
1339. infringes such Recipient's patent(s), then such Recipient's rights granted under
1340. Section 2(b) shall terminate as of the date such litigation is filed.
1341. All Recipient's rights under this Agreement shall terminate if it fails to
1342. comply with any of the material terms or conditions of this Agreement and does
1343. not cure such failure in a reasonable period of time after becoming aware of
1344. such noncompliance. If all Recipient's rights under this Agreement terminate,
1345. Recipient agrees to cease use and distribution of the Program as soon as
1346. reasonably practicable. However, Recipient's obligations under this Agreement
1347. and any licenses granted by Recipient relating to the Program shall continue and
  1348. survive.
1349. Everyone is permitted to copy and distribute copies of this Agreement, but in
1350. order to avoid inconsistency the Agreement is copyrighted and may only be
1351. modified in the following manner. The Agreement Steward reserves the right to
1352. publish new versions (including revisions) of this Agreement from time to time.
1353. No one other than the Agreement Steward has the right to modify this Agreement.
1354. The Eclipse Foundation is the initial Agreement Steward. The Eclipse Foundation
1355. may assign the responsibility to serve as the Agreement Steward to a suitable
1356. separate entity. Each new version of the Agreement will be given a
1357. distinguishing version number. The Program (including Contributions) may always
1358. be distributed subject to the version of the Agreement under which it was
1359. received. In addition, after a new version of the Agreement is published,
1360. Contributor may elect to distribute the Program (including its Contributions)
1361. under the new version. Except as expressly stated in Sections 2(a) and 2(b)
1362. above, Recipient receives no rights or licenses to the intellectual property of
1363. any Contributor under this Agreement, whether expressly, by implication,
1364. estoppel or otherwise. All rights in the Program not expressly granted under
  1365. this Agreement are reserved.
1366. This Agreement is governed by the laws of the State of New York and the
1367. intellectual property laws of the United States of America. No party to this
1368. Agreement will bring a legal action under this Agreement more than one year
1369. after the cause of action arose. Each party waives its rights to a jury trial in
  1370. any resulting litigation.

1430. PUBLIC LICENSE ("CCPL" OR "LICENSE"). THE WORK IS PROTECTED BY COPYRIGHT AND/OR
1431. OTHER APPLICABLE LAW. ANY USE OF THE WORK OTHER THAN AS AUTHORIZED UNDER THIS
1432. LICENSE OR COPYRIGHT LAW IS PROHIBITED.
1433. BY EXERCISING ANY RIGHTS TO THE WORK PROVIDED HERE, YOU ACCEPT AND AGREE TO BE
1434. BOUND BY THE TERMS OF THIS LICENSE. THE LICENSOR GRANTS YOU THE RIGHTS CONTAINED
1435. HERE IN CONSIDERATION OF YOUR ACCEPTANCE OF SUCH TERMS AND CONDITIONS.
  1436. 1. Definitions
1437. "Collective Work" means a work, such as a periodical issue, anthology or
1438. encyclopedia, in which the Work in its entirety in unmodified form, along with a
1439. number of other contributions, constituting separate and independent works in
1440. themselves, are assembled into a collective whole. A work that constitutes a
1441. Collective Work will not be considered a Derivative Work (as defined below) for
1442. the purposes of this License.
1443. "Derivative Work" means a work based upon the Work or upon the Work and other
1444. pre-existing works, such as a translation, musical arrangement, dramatization,
1445. fictionalization, motion picture version, sound recording, art reproduction,
1446. abridgment, condensation, or any other form in which the Work may be recast,
1447. transformed, or adapted, except that a work that constitutes a Collective Work
1448. will not be considered a Derivative Work for the purpose of this License. For
1449. the avoidance of doubt, where the Work is a musical composition or sound
1450. recording, the synchronization of the Work in timed-relation with a moving image
1451. ("synching") will be considered a Derivative Work for the purpose of this
  1452. License.
1453. "Licensor" means the individual or entity that offers the Work under the terms
  1454. of this License.
1455. "Original Author" means the individual or entity who created the Work.
1456. "Work" means the copyrightable work of authorship offered under the terms of
  1457. this License.
1458. "You" means an individual or entity exercising rights under this License who has
1459. not previously violated the terms of this License with respect to the Work, or
1460. who has received express permission from the Licensor to exercise rights under
1461. this License despite a previous violation.
1462. 2. Fair Use Rights. Nothing in this license is intended to reduce, limit, or
1463. restrict any rights arising from fair use, first sale or other limitations on
1464. the exclusive rights of the copyright owner under copyright law or other
  1465. applicable laws.
1466. 3. License Grant. Subject to the terms and conditions of this License, Licensor
1467. hereby grants You a worldwide, royalty-free, non-exclusive, perpetual (for the
1468. duration of the applicable copyright) license to exercise the rights in the Work
  1469. as stated below:
1470. to reproduce the Work, to incorporate the Work into one or more Collective
  1471. Works, and to reproduce the Work as incorporated in the Collective Works;
  1472. to create and reproduce Derivative Works;
1473. to distribute copies or phonorecords of, display publicly, perform publicly, and
1474. perform publicly by means of a digital audio transmission the Work including as
  1475. incorporated in Collective Works;
1476. to distribute copies or phonorecords of, display publicly, perform publicly, and
1477. perform publicly by means of a digital audio transmission Derivative Works.
1478. For the avoidance of doubt, where the work is a musical composition:
1479. Performance Royalties Under Blanket Licenses. Licensor waives the exclusive
1480. right to collect, whether individually or via a performance rights society (e.g.
1481. ASCAP, BMI, SESAC), royalties for the public performance or public digital
1482. performance (e.g. webcast) of the Work.
1483. Mechanical Rights and Statutory Royalties. Licensor waives the exclusive right
1484. to collect, whether individually or via a music rights agency or designated
1485. agent (e.g. Harry Fox Agency), royalties for any phonorecord You create from the
1486. Work ("cover version") and distribute, subject to the compulsory license created
1487. by 17 USC Section 115 of the US Copyright Act (or the equivalent in other
  1488. jurisdictions).
1489. Webcasting Rights and Statutory Royalties. For the avoidance of doubt, where the
1490. Work is a sound recording, Licensor waives the exclusive right to collect,
1491. whether individually or via a performance-rights society (e.g. SoundExchange),
1492. royalties for the public digital performance (e.g. webcast) of the Work, subject
1493. to the compulsory license created by 17 USC Section 114 of the US Copyright Act
1494. (or the equivalent in other jurisdictions).
1495. The above rights may be exercised in all media and formats whether now known or
1496. hereafter devised. The above rights include the right to make such modifications
1497. as are technically necessary to exercise the rights in other media and formats.
1498. All rights not expressly granted by Licensor are hereby reserved.
1499. 4. Restrictions. The license granted in Section 3 above is expressly made subject
1500. to and limited by the following restrictions:
1501. You may distribute, publicly display, publicly perform, or publicly digitally
1502. perform the Work only under the terms of this License, and You must include a
1503. copy of, or the Uniform Resource Identifier for, this License with every copy or
1504. phonorecord of the Work You distribute, publicly display, publicly perform, or
1505. publicly digitally perform. You may not offer or impose any terms on the Work
1506. that alter or restrict the terms of this License or the recipients' exercise of
1507. the rights granted hereunder. You may not sublicense the Work. You must keep
1508. intact all notices that refer to this License and to the disclaimer of
1509. warranties. You may not distribute, publicly display, publicly perform, or
1510. publicly digitally perform the Work with any technological measures that control
1511. access or use of the Work in a manner inconsistent with the terms of this
1512. License Agreement. The above applies to the Work as incorporated in a Collective
1513. Work, but this does not require the Collective Work apart from the Work itself
1514. to be made subject to the terms of this License. If You create a Collective
1515. Work, upon notice from any Licensor You must, to the extent practicable, remove
1516. from the Collective Work any credit as required by clause 4(b), as requested. If
1517. You create a Derivative Work, upon notice from any Licensor You must, to the
1518. extent practicable, remove from the Derivative Work any credit as required by
  1519. clause 4(b), as requested.
1520. If you distribute, publicly display, publicly perform, or publicly digitally
1521. perform the Work or any Derivative Works or Collective Works, You must keep
1522. intact all copyright notices for the Work and provide, reasonable to the medium
1523. or means You are utilizing: (i) the name of the Original Author (or pseudonym,
1524. if applicable) if supplied, and/or (ii) if the Original Author and/or Licensor
1525. designate another party or parties (e.g. a sponsor institute, publishing entity,
1526. journal) for attribution in Licensor's copyright notice, terms of service or by
1527. other reasonable means, the name of such party or parties; the title of the Work
1528. if supplied; to the extent reasonably practicable, the Uniform Resource
1529. Identifier, if any, that Licensor specifies to be associated with the Work,
1530. unless such URI does not refer to the copyright notice or licensing information
1531. for the Work; and in the case of a Derivative Work, a credit identifying the use
1532. of the Work in the Derivative Work (e.g., "French translation of the Work by
1533. Original Author," or "Screenplay based on original Work by Original Author").
1534. Such credit may be implemented in any reasonable manner; provided, however, that
1535. in the case of a Derivative Work or Collective Work, at a minimum such credit
1536. will appear where any other comparable authorship credit appears and in a manner
1537. at least as prominent as such other comparable authorship credit.
1538. 5. Representations, Warranties and Disclaimer
1539. UNLESS OTHERWISE MUTUALLY AGREED TO BY THE PARTIES IN WRITING, LICENSOR OFFERS
1540. THE WORK AS-IS AND MAKES NO REPRESENTATIONS OR WARRANTIES OF ANY KIND CONCERNING
1541. THE WORK, EXPRESS, IMPLIED, STATUTORY OR OTHERWISE, INCLUDING, WITHOUT
1542. LIMITATION, WARRANTIES OF TITLE, MERCHANTIBILITY, FITNESS FOR A PARTICULAR
1543. PURPOSE, NONINFRINGEMENT, OR THE ABSENCE OF LATENT OR OTHER DEFECTS, ACCURACY,
1544. OR THE PRESENCE OF ABSENCE OF ERRORS, WHETHER OR NOT DISCOVERABLE. SOME
1545. JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES, SO SUCH
1546. EXCLUSION MAY NOT APPLY TO YOU.
1547. 6. Limitation on Liability. EXCEPT TO THE EXTENT REQUIRED BY APPLICABLE LAW, IN
1548. NO EVENT WILL LICENSOR BE LIABLE TO YOU ON ANY LEGAL THEORY FOR ANY SPECIAL,
1549. INCIDENTAL, CONSEQUENTIAL, PUNITIVE OR EXEMPLARY DAMAGES ARISING OUT OF THIS
1550. LICENSE OR THE USE OF THE WORK, EVEN IF LICENSOR HAS BEEN ADVISED OF THE
  1551. POSSIBILITY OF SUCH DAMAGES.
  1552. 7. Termination
1553. This License and the rights granted hereunder will terminate automatically upon
1554. any breach by You of the terms of this License. Individuals or entities who have
1555. received Derivative Works or Collective Works from You under this License,
1556. however, will not have their licenses terminated provided such individuals or
1557. entities remain in full compliance with those licenses. Sections 1, 2, 5, 6, 7,
1558. and 8 will survive any termination of this License.
1559. Subject to the above terms and conditions, the license granted here is perpetual
1560. (for the duration of the applicable copyright in the Work). Notwithstanding the
1561. above, Licensor reserves the right to release the Work under different license
1562. terms or to stop distributing the Work at any time; provided, however that any
1563. such election will not serve to withdraw this License (or any other license that
1564. has been, or is required to be, granted under the terms of this License), and
1565. this License will continue in full force and effect unless terminated as stated
  1566. above.
  1567. 8. Miscellaneous
1568. Each time You distribute or publicly digitally perform the Work or a Collective
1569. Work, the Licensor offers to the recipient a license to the Work on the same
1570. terms and conditions as the license granted to You under this License.
1571. Each time You distribute or publicly digitally perform a Derivative Work,
1572. Licensor offers to the recipient a license to the original Work on the same
1573. terms and conditions as the license granted to You under this License.
1574. If any provision of this License is invalid or unenforceable under applicable
1575. law, it shall not affect the validity or enforceability of the remainder of the
1576. terms of this License, and without further action by the parties to this
1577. agreement, such provision shall be reformed to the minimum extent necessary to
1578. make such provision valid and enforceable.
1579. No term or provision of this License shall be deemed waived and no breach
1580. consented to unless such waiver or consent shall be in writing and signed by the
1581. party to be charged with such waiver or consent.
1582. This License constitutes the entire agreement between the parties with respect
1583. to the Work licensed here. There are no understandings, agreements or
1584. representations with respect to the Work not specified here. Licensor shall not
1585. be bound by any additional provisions that may appear in any communication from
1586. You. This License may not be modified without the mutual written agreement of
  1587. the Licensor and You.
