  2. for the JAVA SE DEVELOPMENT KIT (JDK), VERSION 6
  3. ORACLE CORPORATION ("ORACLE") IS WILLING TO LICENSE THE SOFTWARE
  4. IDENTIFIED BELOW TO YOU ONLY UPON THE CONDITION THAT YOU ACCEPT ALL OF
  5. THE TERMS CONTAINED IN THIS BINARY CODE LICENSE AGREEMENT AND
  6. SUPPLEMENTAL LICENSE TERMS (COLLECTIVELY "AGREEMENT"). PLEASE READ
  7. THE AGREEMENT CAREFULLY. BY USING THE SOFTWARE YOU ACKNOWLEDGE THAT
  8. YOU HAVE READ THE TERMS AND AGREE TO THEM. IF YOU ARE AGREEING TO
  9. THESE TERMS ON BEHALF OF A COMPANY OR OTHER LEGAL ENTITY, YOU
  10. REPRESENT THAT YOU HAVE THE LEGAL AUTHORITY TO BIND THE LEGAL ENTITY
  11. TO THESE TERMS. IF YOU DO NOT HAVE SUCH AUTHORITY, OR IF YOU DO NOT
  12. WISH TO BE BOUND BY THE TERMS, THEN YOU MUST NOT USE THE SOFTWARE ON
  13. THIS SITE OR ANY OTHER MEDIA ON WHICH THE SOFTWARE IS CONTAINED.
  14. 1. DEFINITIONS. "Software" means the identified above in binary
  15. form, any other machine readable materials (including, but not limited
  16. to, libraries, source files, header files, and data files), any
  17. updates or error corrections provided by Oracle, and any user manuals,
  18. programming guides and other documentation provided to you by Oracle
  19. under this Agreement. "General Purpose Desktop Computers and Servers"
  20. means computers, including desktop and laptop computers, or servers,
  21. used for general computing functions under end user control (such as
  22. but not specifically limited to email, general purpose Internet
  23. browsing, and office suite productivity tools). The use of Software
  24. in systems and solutions that provide dedicated functionality (other
  25. than as mentioned above) or designed for use in embedded or
  26. function-specific software applications, for example but not limited
  27. to: Software embedded in or bundled with industrial control systems,
  28. wireless mobile telephones, wireless handheld devices, netbooks,
  29. kiosks, TV/STB, Blu-ray Disc devices, telematics and network control
  30. switching equipment, printers and storage management systems, and
  31. other related systems are excluded from this
  32. definition and not licensed under this Agreement. "Programs" means
  33. Java technology applets and applications intended to run on the Java
  34. Platform Standard Edition (Java SE) platform on Java-enabled General
  35. Purpose Desktop Computers and Servers.
  36. 2. LICENSE TO USE. Subject to the terms and conditions of this
  37. Agreement, including, but not limited to the Java Technology
  38. Restrictions of the Supplemental License Terms, Oracle grants you a
  39. non-exclusive, non-transferable, limited license without license fees
  40. to reproduce and use internally Software complete and unmodified for
  41. the sole purpose of running Programs. Additional licenses for
  42. developers and/or publishers are granted in the Supplemental License
  43. Terms.
  44. 3. RESTRICTIONS. Software is confidential and copyrighted. Title to
  45. Software and all associated intellectual property rights is retained
  46. by Oracle and/or its licensors. Unless enforcement is prohibited by
  47. applicable law, you may not modify, decompile, or reverse engineer
  48. Software. You acknowledge that Licensed Software is not designed or
  49. intended for use in the design, construction, operation or maintenance
  50. of any nuclear facility. Oracle Corporation disclaims any express or
  51. implied warranty of fitness for such uses. No right, title or
  52. interest in or to any trademark, service mark, logo or trade name of
  53. Oracle or its licensors is granted under this Agreement. Additional
  54. restrictions for developers and/or publishers licenses are set forth
  55. in the Supplemental License Terms.
  56. 4. LIMITED WARRANTY. Oracle warrants to you that for a period of
  57. ninety (90) days from the date of purchase, as evidenced by a copy of
  58. the receipt, the media on which Software is furnished (if any) will be
  59. free of defects in materials and workmanship under normal use. Except
  60. for the foregoing, Software is provided "AS IS". Your exclusive
  61. remedy and Oracle's entire liability under this limited warranty will
  62. be at Oracle's option to replace Software media or refund the fee paid
  63. for Software. Any implied warranties on the Software are limited to
  64. 90 days. Some states do not allow limitations on duration of an
  65. implied warranty, so the above may not apply to you. This limited
  66. warranty gives you specific legal rights. You may have others, which
  67. vary from state to state.
  68. 5. DISCLAIMER OF WARRANTY. UNLESS SPECIFIED IN THIS AGREEMENT, ALL
  69. EXPRESS OR IMPLIED CONDITIONS, REPRESENTATIONS AND WARRANTIES,
  70. INCLUDING ANY IMPLIED WARRANTY OF MERCHANTABILITY, FITNESS FOR A
  71. PARTICULAR PURPOSE OR NON-INFRINGEMENT ARE DISCLAIMED, EXCEPT TO THE
  72. EXTENT THAT THESE DISCLAIMERS ARE HELD TO BE LEGALLY INVALID.
  73. 6. LIMITATION OF LIABILITY. TO THE EXTENT NOT PROHIBITED BY LAW, IN
  74. NO EVENT WILL ORACLE OR ITS LICENSORS BE LIABLE FOR ANY LOST REVENUE,
  75. PROFIT OR DATA, OR FOR SPECIAL, INDIRECT, CONSEQUENTIAL, INCIDENTAL OR
  76. PUNITIVE DAMAGES, HOWEVER CAUSED REGARDLESS OF THE THEORY OF
  77. LIABILITY, ARISING OUT OF OR RELATED TO THE USE OF OR INABILITY TO USE
  78. SOFTWARE, EVEN IF ORACLE HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH
  79. DAMAGES. In no event will Oracle's liability to you, whether in
  80. contract, tort (including negligence), or otherwise, exceed the amount
  81. paid by you for Software under this Agreement. The foregoing
  82. limitations will apply even if the above stated warranty fails of its
  83. essential purpose. Some states do not allow the exclusion of
  84. incidental or consequential damages, so some of the terms above may
  85. not be applicable to you.
  86. 7. TERMINATION. This Agreement is effective until terminated. You
  87. may terminate this Agreement at any time by destroying all copies of
  88. Software. This Agreement will terminate immediately without notice
  89. from Oracle if you fail to comply with any provision of this
  90. Agreement. Either party may terminate this Agreement immediately
  91. should any Software become, or in either party's opinion be likely to
  92. become, the subject of a claim of infringement of any intellectual
  93. property right. Upon Termination, you must destroy all copies of
  94. Software.
  95. 8. EXPORT REGULATIONS. All Software and technical data delivered
  96. under this Agreement are subject to US export control laws and may be
  97. subject to export or import regulations in other countries. You agree
  98. to comply strictly with all such laws and regulations and acknowledge
  99. that you have the responsibility to obtain such licenses to export,
  100. re-export, or import as may be required after delivery to you.
  101. 9. TRADEMARKS AND LOGOS. You acknowledge and agree as between you
  102. and Oracle that Oracle owns the ORACLE, SOLARIS, JAVA, JINI, FORTE,
  103. and iPLANET trademarks and all ORACLE, SOLARIS, JAVA, JINI, FORTE, and
  104. iPLANET-related trademarks, service marks, logos and other brand
  105. designations ("Oracle Marks"), and you agree to comply with the Third
  106. Party Usage Guidelines for Oracle Trademarks currently located at
  107. http://www.oracle.com/html/3party.html. Any use you make of the
  108. Oracle Marks inures to Oracle's benefit.
  109. 10. U.S. GOVERNMENT RESTRICTED RIGHTS. If Software is being
  110. acquired by or on behalf of the U.S. Government or by a U.S.
  111. Government prime contractor or subcontractor (at any tier), then the
  112. Government's rights in Software and accompanying documentation will be
  113. only as set forth in this Agreement; this is in accordance with 48 CFR
  114. 227.7201 through 227.7202-4 (for Department of Defense (DOD)
  115. acquisitions) and with 48 CFR 2.101 and 12.212 (for non-DOD
  116. acquisitions).
  117. 11. GOVERNING LAW. Any action related to this Agreement will be
  118. governed by California law and controlling U.S. federal law. No
  119. choice of law rules of any jurisdiction will apply.
  120. 12. SEVERABILITY. If any provision of this Agreement is held to be
  121. unenforceable, this Agreement will remain in effect with the provision
  122. omitted, unless omission would frustrate the intent of the parties, in
  123. which case this Agreement will immediately terminate.
  124. 13. INTEGRATION. This Agreement is the entire agreement between you
  125. and Oracle relating to its subject matter. It supersedes all prior or
  126. contemporaneous oral or written communications, proposals,
  127. representations and warranties and prevails over any conflicting or
  128. additional terms of any quote, order, acknowledgment, or other
  129. communication between the parties relating to its subject matter
  130. during the term of this Agreement. No modification of this Agreement
  131. will be binding, unless in writing and signed by an authorized
  132. representative of each party.
  133. SUPPLEMENTAL LICENSE TERMS
  134. These Supplemental License Terms add to or modify the terms of the
  135. Binary Code License Agreement. Capitalized terms not defined in these
  136. Supplemental Terms shall have the same meanings ascribed to them in
  137. the Binary Code License Agreement . These Supplemental Terms shall
  138. supersede any inconsistent or conflicting terms in the Binary Code
  139. License Agreement, or in any license contained within the Software.
  140. A. Software Internal Use and Development License Grant. Subject to
  141. the terms and conditions of this Agreement and restrictions and
  142. exceptions set forth in the Software "README" file incorporated herein
  143. by reference, including, but not limited to the Java Technology
  144. Restrictions of these Supplemental Terms, Oracle grants you a
  145. non-exclusive, non-transferable, limited license without fees to
  146. reproduce internally and use internally the Software complete and
  147. unmodified for the purpose of designing, developing, and testing your
  148. Programs.
  149. B. License to Distribute Software. Subject to the terms and
  150. conditions of this Agreement and restrictions and exceptions set forth
  151. in the Software README file, including, but not limited to the Java
  152. Technology Restrictions of these Supplemental Terms, Oracle grants you
  153. a non-exclusive, non-transferable, limited license without fees to
  154. reproduce and distribute the Software, provided that (i) you
  155. distribute the Software complete and unmodified and only bundled as
  156. part of, and for the sole purpose of running, your Programs, (ii) the
  157. Programs add significant and primary functionality to the Software,
  158. (iii) you do not distribute additional software intended to replace
  159. any component(s) of the Software, (iv) you do not remove or alter any
  160. proprietary legends or notices contained in the Software, (v) you only
  161. distribute the Software subject to a license agreement that protects
  162. Oracle's interests consistent with the terms contained in this
  163. Agreement, and (vi) you agree to defend and indemnify Oracle and its
  164. licensors from and against any damages, costs, liabilities, settlement
  165. amounts and/or expenses (including attorneys' fees) incurred in
  166. connection with any claim, lawsuit or action by any third party that
  167. arises or results from the use or distribution of any and all Programs
  168. and/or Software.
  169. C. License to Distribute Redistributables. Subject to the terms and
  170. conditions of this Agreement and restrictions and exceptions set forth
  171. in the Software README file, including but not limited to the Java
  172. Technology Restrictions of these Supplemental Terms, Oracle grants you
  173. a non-exclusive, non-transferable, limited license without fees to
  174. reproduce and distribute those files specifically identified as
  175. redistributable in the Software "README" file ("Redistributables")
  176. provided that: (i) you distribute the Redistributables complete and
  177. unmodified, and only bundled as part of Programs, (ii) the Programs
  178. add significant and primary functionality to the Redistributables,
  179. (iii) you do not distribute additional software intended to supersede
  180. any component(s) of the Redistributables (unless otherwise specified
  181. in the applicable README file), (iv) you do not remove or alter any
  182. proprietary legends or notices contained in or on the
  183. Redistributables, (v) you only distribute the Redistributables
  184. pursuant to a license agreement that protects Oracle's interests
  185. consistent with the terms contained in the Agreement, (vi) you agree
  186. to defend and indemnify Oracle and its licensors from and against any
  187. damages, costs, liabilities, settlement amounts and/or expenses
  188. (including attorneys' fees) incurred in connection with any claim,
  189. lawsuit or action by any third party that arises or results from the
  190. use or distribution of any and all Programs and/or Software.
  191. D. Java Technology Restrictions. You may not create, modify, or
  192. change the behavior of, or authorize your licensees to create, modify,
  193. or change the behavior of, classes, interfaces, or subpackages that
  194. are in any way identified as "java", "javax", "sun" or similar
  195. convention as specified by Oracle in any naming convention
  196. designation.
  197. E. Distribution by Publishers. This section pertains to your
  198. distribution of the Software with your printed book or magazine (as
  199. those terms are commonly used in the industry) relating to Java
  200. technology ("Publication"). Subject to and conditioned upon your
  201. compliance with the restrictions and obligations contained in the
  202. Agreement, in addition to the license granted in Paragraph 1 above,
  203. Oracle hereby grants to you a non-exclusive, nontransferable limited
  204. right to reproduce complete and unmodified copies of the Software on
  205. electronic media (the "Media") for the sole purpose of inclusion and
  206. distribution with your Publication(s), subject to the following terms:
  207. (i) You may not distribute the Software on a stand-alone basis; it
  208. must be distributed with your Publication(s); (ii) You are responsible
  209. for downloading the Software from the applicable Oracle web site;
  210. (iii) You must refer to the Software as JavaTM SE Development Kit 6;
  211. (iv) The Software must be reproduced in its entirety and without any
  212. modification whatsoever (including, without limitation, the Binary
  213. Code License and Supplemental License Terms accompanying the Software
  214. and proprietary rights notices contained in the Software); (v) The
  215. Media label shall include the following information: Copyright 2006,
  216. 2010, Oracle Corporation All rights reserved. Use is subject to
  217. license terms. Oracle, Sun, Sun Microsystems, the Sun logo, Solaris,
  218. Java, the Java Coffee Cup logo, J2SE, and all trademarks and logos
  219. based on Java are trademarks or registered trademarks of Oracle
  220. Corporation in the U.S. and other countries. This information must
  221. be placed on the Media label in such a manner as to only apply to the
  222. Oracle Software; (vi) You must clearly identify the Software as
  223. Oracle's product on the Media holder or Media label, and you may not
  224. state or imply that Oracle is responsible for any third-party software
  225. contained on the Media; (vii) You may not include any third party
  226. software on the Media which is intended to be a replacement or
  227. substitute for the Software; (viii) You shall indemnify Oracle for all
  228. damages arising from your failure to comply with the requirements of
  229. this Agreement. In addition, you shall defend, at your expense, any
  230. and all claims brought against Oracle by third parties, and shall pay
  231. all damages awarded by a court of competent jurisdiction, or such
  232. settlement amount negotiated by you, arising out of or in connection
  233. with your use, reproduction or distribution of the Software and/or the
  234. Publication. Your obligation to provide indemnification under this
  235. section shall arise provided that Oracle: (a) provides you prompt
  236. notice of the claim; (b) gives you sole control of the defense and
  237. settlement of the claim; (c) provides you, at your expense, with all
  238. available information, assistance and authority to defend; and (d) has
  239. not compromised or settled such claim without your prior written
  240. consent; and (ix) You shall provide Oracle with a written notice for
  241. each Publication; such notice shall include the following information:
  242. (1) title of Publication, (2) author(s), (3) date of Publication, and
  243. (4) ISBN or ISSN numbers. Such notice shall be sent to Oracle
  244. Corporation, 500 Oracle Parkway, Redwood Shores, California 94065
  245. U.S.A , Attention: Contracts Administration.
  246. F. Source Code. Software may contain source code that, unless
  247. expressly licensed for other purposes, is provided solely for
  248. reference purposes pursuant to the terms of this Agreement. Source
  249. code may not be redistributed unless expressly provided for in this
  250. Agreement.
  251. G. Third Party Code. Additional copyright notices and license terms
  252. applicable to portions of the Software are set forth in the
  253. THIRDPARTYLICENSEREADME.txt file. In addition to any terms and
  254. conditions of any third party opensource/freeware license identified
  255. in the THIRDPARTYLICENSEREADME.txt file, the disclaimer of warranty
  256. and limitation of liability provisions in paragraphs 5 and 6 of the
  257. Binary Code License Agreement shall apply to all Software in this
  258. distribution.
  259. H. Termination for Infringement. Either party may terminate this
  260. Agreement immediately should any Software become, or in either party's
  261. opinion be likely to become, the subject of a claim of infringement of
  262. any intellectual property right.
  263. I. Installation and Auto-Update. The Software's installation and
  264. auto-update processes transmit a limited amount of data to Oracle (or
  265. its service provider) about those specific processes to help Oracle
  266. understand and optimize them. Oracle does not associate the data with
  267. personally identifiable information. You can find more information
  268. about the data Oracle collects at http://java.com/data/.
